On the afternoon of May 23, the National Assembly discussed in the hall on the Law on Amending and Supplementing a number of articles of the Bidding Law; Law on Investment by the method of public -private partnership; Customs Law; Law on Export and Import Tax; Investment Law; Law on Public Investment; Law on management and use of public assets.
Delegate Ta Van Ha - Vice Chairman of the Committee for Culture and Society (Quang Nam Delegation) commented on the draft Law on Bidding.
The delegate said that many national key projects have previously used the bidding method. Currently, the draft law has proposed to allow investors to apply the form of contractor selection based on scale, nature, and conditions.
According to the delegate, this authority needs to be considered more carefully. First of all, bidding is a legal tool to ensure publicity and transparency in the selection of contractors so that fairness is objective.
At the same time, it is necessary to improve and enhance the effectiveness of state management, the efficiency of the use of the state budget and public assets. It also helps protect the legitimate rights and interests of participants.
Regarding this solution, the delegate said that according to the explanation of the agencies, there are two goals. First, quickly shorten the time. Second is the responsibility of the leader.
However, the delegate said that the practical handling of violations related to bidding in the past showed that there were cases that were handled only using the method of bidding designation or violating bidding procedures to shorten the time?
At the same time, no one should be handled other than the responsibility of the head and related responsible people. However, in the past, there have been many cases of law evasion, trying to violate regulations to bid, with negativity, group interests, and personal interests.
According to the delegate, this is the reason that causes confusion in the implementation process. Therefore, it needs to be carefully considered and strictly regulated in the draft law.
"The previous strict regulations still have negative consequences. If not researched carefully, it would be reasonable to consider the problem of negative outcomes. Therefore, I suggest careful research so as not to lose staff," said delegate Ta Van Ha.
Regarding the amendment of the Law on Bidding, delegate Nguyen Tam Hung (Ba Ria - Vung Tau delegation) proposed to clearly supplement the bidding authority of People's Committees and Chairmen of People's Committees at all levels to suit the organization of local government in the direction of two levels.
The delegate said that current regulations only generalise "authorized person" and "investor", easily causing confusion in assigning and determining responsibilities.
Delegates propose the provincial People's Committee as a state management agency on bidding in the area; The Chairman of the Provincial People's Committee has the authority to approve the plan, the results of the contractor selection with the provincial bidding packages.
At the same time, the People's Committee of the commune is allowed to bid for small -scale projects using the commune budget or assigned, the Chairman of the People's Committee of the commune is the person who is responsible for directly organizing and approving.
