The Ministry of Home Affairs issued Decision 863/QD-BNV announcing newly issued and abolished administrative procedures in the field of social insurance (SI) under the management of the Ministry. Notably, the procedure for receiving sick leave benefits is specifically regulated, creating convenience for employees during the implementation process.
Implementation procedures
Step 1: The employee submits the application to the employer, no later than 45 days from the date of return to work.
Step 2: Within 7 working days from the date of receiving the complete application, the employer shall make a list and submit the application to the Social Insurance agency.
Step 3: Within 7 working days from receiving the complete application, the Social Insurance agency must resolve the issue, if it refuses, there must be a document stating the reason.
Implementation: directly, online or by post.
Component of the dossier
Resident treatment: Hospital discharge certificate, summary of medical records or documents proving the residence treatment process; list of employees on sick leave issued by the unit.
Outpatient treatment: Certificate of leave to receive social insurance; discharge certificate or medical records with appointment for outpatient treatment; list of employees on leave to receive benefits.
Medical examination and treatment abroad: Treatment records showing the name of the disease and treatment time issued by a foreign medical facility; with a notarized Vietnamese translation, legalizing consular practice (except in cases of exemption).
Number of documents: not specified. Processing time: maximum 7 working days from the date of receiving complete documents from the employer.
Subjects and agencies to resolve
Employees who are Vietnamese citizens, foreign workers in Vietnam and employers can all carry out the procedures. The Social Insurance Agency according to the decentralization of Vietnam Social Insurance receives and resolves. The result was a list of sick leave beneficiaries, no fee collection.
Conditions for receiving allowances
Employees are entitled to benefits upon leave to:
Treatment of diseases not related to occupational diseases or accidents other than work accidents.
Treat accidents on the way to work and home by route and at reasonable times.
Rehabilitation due to recurrent occupational accidents and diseases.
Seeds, removals, transplant tissues and human body parts.
Taking care of a sick child under 7 years old.
Employees are not entitled to sick leave if they cause injuries; use drugs or drug precursors in violation of regulations; are on first-time treatment leave due to work-related accidents or occupational diseases; The leave time coincides with leave under labor law, leave with full salary, maternity leave, and health recovery.
