The Ministry of Health has just sent a document to the Ministry of Finance, People's Committees of provinces and centrally run cities on the implementation of health insurance policies for a number of subjects participating in health insurance.
According to the Ministry of Health, on November 27, 2024, the National Assembly issued Law No. 51/2024/QH15 amending and supplementing a number of articles of the Law on Health Insurance, effective from July 1, 2025.
The Government issued Decree No. 188 detailing and guiding the implementation of a number of articles of the Law on Health Insurance and Decree No. 176 dated June 30, 2025 detailing and guiding the implementation of a number of articles of the Law on Social Insurance on social pension benefits.
To unify the implementation of health insurance policies for people who are receiving monthly social allowances to receive monthly social pension benefits from July 1, 2025 according to the provisions of law, the Ministry of Health has the following opinion:
Regarding the level of benefits within the scope of health insurance benefits, the Ministry of Health clearly states:
Point a, Clause 7, Article 12 of the Law on Health Insurance stipulates that the Government stipulates that other subjects other than those specified in Clauses 1, 2, 3, 4, 5 and 6 of this Article include: Subjects participating in health insurance regulated by law before January 1, 2025;
Clause 6, Article 5 of Decree No. 188 stipulates: People participating in resistance war, national defense, international service and other subjects who have been paid by the state budget for health insurance according to the provisions of the legal documents issued before January 1, 2025 participate in health insurance according to the group paid by the state budget prescribed in Clause 3, Article 12 of the Law on Health Insurance;
At the same time, Point a, Clause 1, Article 15 of Decree No. 188 stipulates the beneficiary level for this subject as follows: Health insurance participants who are subjects specified in Clauses 1, 2, 3, 4, 5, 6 and 7, Article 5 of this Decree when examining and treating diseases as prescribed in Articles 26 and 27 of the Law on Health Insurance will be paid by the Health Insurance Fund for medical examination and treatment within the scope of benefits with the following beneficiary level: 100% of medical examination and treatment costs for subjects specified in Clauses 2 and 6, Article 5 of this Decree;".
Clause 1, Article 7 of Decree No. 176 stipulates: Subjects specified in Point b and Point c, Clause 5, Article 5 of Decree No. 20/2021/ND-CP dated March 15, 2021 of the Government regulating social assistance policies for social protection beneficiaries who are receiving monthly social allowances and are eligible for social pension benefits will be converted to social pension benefits from the effective date of this decree.
Regarding health insurance policies before July 1, 2025 for people eligible for benefits and social assistance, they have been stipulated in legal documents issued before January 1, 2025.
Thus, according to the Ministry of Health, subjects who are beneficiaries of monthly social allowance and assistance policies from July 1, 2025 onwards according to the provisions of the law on the elderly, people with disabilities, and social assistance participating in health insurance according to the group of subjects paid by the state budget for health insurance and have a 100% allowance for medical examination and treatment costs within the scope of benefits according to the provisions of the law on health insurance issued before January 1, 2025 and from July 1, 2025 onwards to receive social pension benefits according to the provisions of Article 7 of Decree No. 176/2025/ND-CP will continue to receive health insurance from the state budget and will receive 100% of medical examination and treatment costs within the scope of benefits according to the provisions of Clause 6, Article 5 and Clause 1, Article 188 of 15 of Decree No. NCP/2525/ND-ND-ND-ND.
Other beneficiaries of social pension benefits shall comply with the provisions of the Law on Health Insurance.
To ensure the stability of the rights of health insurance participants in a continuous and uninterrupted manner, the Ministry of Health recommends that the Ministry of Finance direct the Vietnam Social Insurance to continue to maintain and supplement the subject codes and health insurance participation rights codes of the above subjects according to the provisions of the law on health insurance.
The Ministry of Health requests the People's Committees of provinces and centrally run cities to direct relevant agencies and units to implement to ensure the provisions of the law on health insurance, ensuring stable and continuous rights for health insurance participants.
