The 16th National Assembly passed the Law on Civil Status (amended), this law takes effect from March 1, 2027.
This Law clearly states the respect and assurance of personal rights of individuals. All civil status events of individuals must be fully, promptly, truthfully, objectively and accurately registered; in case they do not meet the conditions for civil status registration according to the provisions of law, the head of the civil status registration agency shall refuse in writing and state the reason.
For civil status registration, if the law on civil status does not stipulate a time limit for resolution, it must be resolved within 24 hours from the time of receiving complete and valid dossiers.
An event or civil status information of an individual is registered once by a competent civil status registration agency of Vietnam, except for the case of re-registration of marriage. The civil status registration agency is responsible for ensuring that the event or civil status information of the registered individual does not overlap.
Ensure publicity and transparency of civil status registration procedures. Strengthen proactive civil status registration, interlink civil status registration procedures with related procedures, ensuring that people only provide information once.
The civil status registration agency is responsible for proactively exploiting electronic data, searching for information in relevant databases, in accordance with the response level of the database, not requiring the submission, presentation or upload of documents as components of the dossier, except in cases where information cannot be exploited or the exploited information is incomplete or inaccurate.
The collection, processing, storage, sharing, and exploitation of civil status data must ensure safety, confidentiality, for the right purpose, and in accordance with regulations on personal data protection.
The revised Law on Civil Status just passed by the National Assembly also stipulates the handling of violations in civil status registration and management activities.
Through this, agencies, organizations, and individuals who violate the provisions of the law on civil status, depending on the nature and severity of the violation, may be administratively sanctioned, disciplined, or prosecuted for criminal liability according to the provisions of law.
Civil status papers and civil status registration content issued, registered, and certified due to acts violating the provisions of the law on civil status must be amended, rectified, or revoked or canceled.
