On the morning of August 12, the National Assembly Standing Committee gave its opinion on the draft Law on Enforcement of Criminal Judgments (amended).
This is a draft law with a large scope of amendments, with 124/207 articles amended, 10 articles supplemented and 22 articles abolished, which the delegates assessed as a comprehensive and fundamental amendment.
One of the outstanding policies is to supplement regulations on the collection of biometric information of prisoners in cases where there is no information when receiving prisoners.
According to the draft, the collection of biometric information of prisoners includes photos of faces, fingers, eyelids, DNA, and voices for cases with no information.
Preliminary review of this content, Chairman of the Law and Justice Committee Hoang Thanh Tung said that the majority of opinions of the Standing Committee agreed to supplement regulations on collecting biometric information of prisoners who do not have information.
However, this requirement will incur a huge amount of funding, and it is recommended that the drafting agency clarify the purpose of collecting biometric information of prisoners.
At the same time, it is necessary to increase the application of digital transformation and information technology to share and update data, avoiding waste in the implementation process.
Giving his explanation later, Senior Lieutenant General Le Quoc Hung - Deputy Minister of Public Security - said that adding the regulation on collecting biometric information for prisoners is an inheritance of the previous regulation.
Accordingly, all prisoners when admitted must have biometrics. Previously, only one content was taken as an index, only an index. Currently, it has developed into other types such as DNA, cataracts, blood, and voice.
Senior Lieutenant General Le Quoc Hung said that for this group of subjects, they have lost some civil rights, so it is normal for the law to add issues related to biometrics, not violating human rights.
"The basic infrastructure system for storing human data banks of the Ministry of Public Security has all the conditions to collect biometrics. We can do this in all prisons, detention centers, temporary detention camps, and accommodation facilities without incurring any funding or costs" - Senior Lieutenant General Le Quoc Hung emphasized.
The draft law also adds provisions on health care regimes for prisoners. In particular, it proposed to stipulate that in cases where prisoners have health insurance cards and continue to enjoy health insurance benefits according to regulations, if they exceed the payment limit of health insurance, the State will pay the excess.
Along with that, prisoners are allowed to participate in voluntary social insurance, enjoy social insurance regimes and policies according to the provisions of law.
Reviewing this content, the Standing Committee of the Law and Justice Committee basically approved the regulation plan to allow prisoners with health insurance cards to enjoy health insurance benefits.
In addition, to ensure feasibility, it is recommended that the drafting agency study and supplement regulations to clearly define the settlement of insurance regimes for prisoners with health insurance and the procedures for handling cases exceeding the payment limit of health insurance.
