Ms. My Phuong (Nha Trang City, Khanh Hoa Province) learned from Decree No. 33/2023/ND-CP of the Government stipulating that the standard finance - accounting title must be from university or higher.
According to Clause 3, Article 21 of Decree 174/2016/ND-CP of the Government, the standard for being in charge of accounting is having a chief accountant certificate and having accounting expertise and skills from intermediate level or higher.
"So can commune accountants with intermediate qualifications (not meeting the standards under Decree No. 33/2023/ND-CP) be appointed in charge of accounting?" - Ms. Phuong wondered.
Regarding the reflection and recommendation of Ms. My Phuong, the Ministry of Home Affairs has responded on the Electronic Information Portal.
The Ministry of Home Affairs said that Point c Clause 2, Clause 3 Article 10 of Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government regulating commune-level cadres, civil servants and non-professional workers at the commune level, in villages and residential groups stipulates:
Professional qualifications: University degree or higher in a field of training appropriate to the job requirements of each commune-level civil servant position.
In case the law has provisions different from those in this Decree, the provisions of that law shall apply; The provincial People's Committee shall specify the professional and technical qualifications from intermediate level and above for commune-level civil servants working in communes, wards and towns in mountainous areas, highlands, border areas, islands, island communes, remote areas, ethnic minority areas and areas with particularly difficult socio-economic conditions.
At the same time, Clause 1, Article 38 of this Decree stipulates: Commune-level civil servants holding the positions specified in Clause 2, Article 5 who do not yet meet the standards specified in Article 10 of Decree No. 33/2023/ND-CP must, within 5 years from the effective date of this Decree, meet the prescribed standards.
After this period, if the prescribed standards are not met, retirement will be implemented (if eligible) or the staff reduction policy will be implemented according to Government regulations.
Decree No. 33 has taken effect from August 1, 2023.
