The Ministry of Justice is reviewing the Draft Decree regulating the minimum wage developed by the Ministry of Home Affairs before submitting it to the Government for approval.
Accordingly, the Draft Decree stipulates the adjustment of the minimum wage to increase by 7.2% compared to the current level to be applied from January 1, 2026.
The draft stipulates the minimum monthly salary levels in 4 regions as follows: Region I is 5,310,000 VND/month, Region II is 4,730,000 VND/month, Region III is 4,140,000 VND/month, Region IV is 3,700,000 VND/month.
The Department of Home Affairs of Dien Bien province has given its opinion on the draft Proposal and the Decree regulating the minimum wage.
The Department of Home Affairs of Dien Bien province basically agrees with the layout and content of the draft Proposal and Decree regulating the minimum wage. However, the Department also has some recommendations.
In Article 2, the subjects of application, the Department proposes to clarify that the provisions on the minimum wage in this Decree do not apply to civil servants, public employees and armed forces to avoid misunderstandings during the implementation process.
Meanwhile, the Vietnam Cooperative Union also proposed to add the subjects of application of the Decree, including "Cooperatives according to the provisions of the Cooperative Law".
Responding to the above opinions, the Ministry of Home Affairs said that Article 2 of the draft Decree clearly stipulates the subjects of application including: Employees working under labor contracts and employers according to the provisions of the Ministry of Labor (excluding civil servants, public employees and armed forces).
On the other hand, employers according to the provisions of the Labor Code, including:
Enterprises according to the provisions of the Law on Enterprises. Agencies, organizations, cooperatives, households and individuals that hire or employ workers to work for them according to the agreement.
Other agencies, organizations and individuals related to the implementation of the minimum wage prescribed in this Decree.
