The Ministry of National Defense received a petition from voters in Lam Dong province transferred by the National Assembly's Committee for Petitions and Supervision regarding responding to voters' petitions sent after the First Session of the 16th National Assembly.
Accordingly, voter Quach Anh Tuan resigned in June 1996, so he is currently not eligible for benefits according to Decision No. 62/2011/QD-TTg dated November 9, 2011 of the Prime Minister on regimes and policies for subjects participating in the war to protect the Fatherland, performing international duties in Cambodia, and helping Laos after April 30, 1975 who have been demobilized, discharged from the army, and resigned.
Voters proposed to study and propose that the Government consider expanding the subjects of application to soldiers who participated in the war to protect the Fatherland after April 30, 1975 and quit their jobs after January 1, 1995 to ensure the rights, regimes, and policies for those who have participated and contributed in the army.

According to the provisions of Decision No. 62/2011/QD-TTg of the Prime Minister and guiding documents for implementation, military personnel enlisted after April 30, 1975, directly participating in the war to protect the Fatherland at the Southwest border, the Northern border, performing tasks of sweeping Ful Ro in the Central Highlands, performing international duties in Cambodia, helping Laos, having served in the army for less than 20 years, have been demobilized, discharged from the army, resigned before April 1, 2000 or transferred to another sector and then resigned before January 1, 1995, currently not eligible for pension benefits, loss of working capacity benefits, monthly sick soldier benefits are considered for settlement of one-time allowance or monthly allowance depending on the actual working time in the army (from 15 years to less than 20 years of actual work in the army is entitled to monthly allowance; less than 15 years of actual work in the army is entitled to one-time allowance).
In case they have not yet enjoyed health insurance benefits, they are entitled to health insurance benefits according to the provisions of the law on health insurance; when they die, the funeral organizer is entitled to funeral expenses according to the provisions of the law on social insurance.
The regulation of subjects and conditions for enjoying the regime according to the above Decision is a concretization of the Politburo's policy in Notice No. 183-TB/TW; Official Dispatch No. 679/TTr-BCSĐC of the Party Committee of the Government reporting to the Politburo and concluded by the Politburo in Notice No. 24-TB/TW dated May 5, 2011.
This is a regime and policy to support subjects directly performing combat missions, serving combat in the Southwest border, the Northern border, performing tasks of sweeping Ful Ro in the Central Highlands within the prescribed area and time, not a regime applied to all cases of enlistment after April 30, 1975 in general and resignation after January 1, 1995 in particular.
Therefore, the proposal to study and consider expanding the subjects eligible for regimes and policies according to Decision No. 62/2011/QD-TTg for soldiers participating in the war to protect the Fatherland after April 30, 1975 who resigned after January 1, 1995 is not consistent with the Conclusion of the Politburo and Decision No. 62/2011/QD-TTg mentioned above.
To ensure social security, at the 7th session, the 15th National Assembly passed the 2024 Law on Social Insurance, effective from July 1, 2025; accordingly, subjects and conditions for enjoying social pension benefits guaranteed by the State budget have been added; in which, cases belonging to poor households, near-poor households with a minimum age of 70 to under 75 years old and cases with a minimum age of 75 or more if they do not have a pension or monthly social insurance allowance are entitled to social pension allowances according to the Government's regulations.
