The Government has issued Decree No. 305/2026/ND-CP amending and supplementing a number of articles of Decree No. 28/2019/ND-CP dated March 20, 2019 of the Government stipulating denunciations and settlement of denunciations in the People's Army.
Decree No. 305/2026/ND-CP amends and supplements Article 1 (on the scope of regulation), Article 2 (on the subjects of application) of Decree No. 28/2019/ND-CP in the direction of adding 3 groups of subjects including: People working in cipher organizations in the Government Cipher Committee under the management authority of the Minister of National Defense; national defense civil servants and contract workers under the Ministry of National Defense.
Decree No. 305/2026/ND-CP supplements Clause 4 after Clause 3 of Article 17 on the responsibilities of Chief Inspectors at all levels in the direction of assigning responsibility for monitoring and urging the implementation of the conclusion of the denunciation content of the person resolving the denunciation and the regulations on the deadline for the inspection agency at the same level or the advisory agency on management and settlement of denunciations to report the results of monitoring and urging the implementation of the conclusion of the denunciation content to the competent person, avoiding the situation of suspending the case and not resolving it thoroughly.
Accordingly, the person handling the denunciation is responsible for monitoring, urging or assigning the same-level inspection agency or assigning the agency or unit advising on the management and resolution of denunciations to monitor and urge the implementation of the conclusions of the denunciation content.
The inspection agency at the same level or the agency or unit advising on the management and resolution of denunciations is responsible for monitoring and urging the implementation of denunciation content conclusions, periodically reporting monthly to the denunciation resolution person on the results of monitoring and urging the implementation of denunciation content conclusions.
Decree Decree No. 305/2026/ND-CP takes effect from September 17, 2026.
Article 17 of Decree No. 28/2019/ND-CP stipulates the responsibilities of Chief Inspectors at all levels.
The Chief Inspector of the Ministry of National Defense is responsible for advising and assisting the Minister of National Defense in managing the work of resolving denunciations and implementing them according to the provisions of Clause 1, Article 32 of the 2018 Law on Denunciations.
Chief Inspectors at all levels are responsible for advising and assisting heads of military administration at the same level, managing the work of resolving denunciations within the scope of decentralized authority;
Receiving, classifying, and handling denunciations; verifying the content of denunciations, concluding the content of verification and proposing measures to handle denunciations under the jurisdiction of the head of military administration at the same level when assigned;
Consider and conclude the settlement of denunciations that the head of military administration of the agency or unit directly subordinate to the head of the same-level agency or unit has resolved but shows signs of violating the law.
In case it is concluded that the resolution of denunciations violates the law, it is recommended that the head of military administration with the authority to resolve denunciations at the same level consider and resolve them again.
Inspect and examine the responsibility of the head of military administration of the agency or unit directly subordinate to the head of military administration at the same level in complying with the law on organization.
For agencies and units that do not have inspection organizations, the person with authority to resolve denunciations assigns the agency or unit under direct management to advise on management and denunciation resolution work.
