This morning (March 11), in Hanoi, the Office of the President held a press conference to announce the President's Order on promulgating the Law on Promulgation of Legal Documents passed by the 15th National Assembly at the 9th Extraordinary Session.
Deputy Head of the Office of the President Pham Thanh Ha chaired the press conference.
The Law on Promulgation of Legal Documents consists of 9 chapters and 72 articles, effective from April 1, 2025.
At the press conference, Deputy Minister of Justice Nguyen Thanh Tinh said that the development of the Law ensures the comprehensive and direct leadership of the Party in law-making work, specifically the timely and complete institutions of the Politburo, the General Secretary, the Prime Minister, and the National Assembly Chairman on strongly innovating the thinking of law-making.
Accordingly, the provisions of the law must be stable and long-term, regulating issues under the authority of the National Assembly, while issues that are frequently changing are assigned to the Government, ministries, branches and localities to regulate.
At the same time, ensure the constitutionality, legality, consistency, and unity of the legal system and compatible with international treaties to which Vietnam is a member; selectively refer to the experiences of other countries in developing and promulgating legal documents...
Along with that, it is necessary to ensure investment in resources for the work of developing and organizing the implementation of legal documents commensurate with the nature of strategic breakthroughs, "breakthrough of breakthroughs"; ensure the connection between the work of developing and organizing the implementation of legal documents.
Providing more information about the process of building new laws according to the provisions of the Law, Deputy Minister of Justice Nguyen Thanh Tinh said that the process both ensures time reduction and still improves "productivity", promptly meets the requirements of the country's development practice in the new era, ensuring the "quality" of legal documents.
Simplifying the system of legal documents, the Law has re-determined the authority to issue legal documents of some entities according to the 2013 Constitution; removed the authority to issue legal documents of commune-level authorities; supplemented 1 form of legal document issued by the Government as a resolution to resolve urgent and important issues arising from practice.
The Deputy Minister of Justice said that the law has stipulated innovation in the development of the National Assembly's legislative program in the direction of both having a strategy and long-term orientation, and being highly flexible, closely following real life, separating the process of making policies from the establishment of annual legislative programs.
In addition to the usual process, to speed up progress and promptly resolve urgent requirements of practice, the law stipulates the development and promulgation of legal documents according to a shortened process and in special cases.
The law assigns ministers to decide and be responsible for applying shortened procedures in developing and promulgating circulars. "According to this regulation, the time to build and issue according to shortened procedures only takes about 1-2 months (down 6-8 months compared to the current one)," said the Deputy Minister of Justice.
