At the 9th Session on May 8, the National Assembly listened to the presentation and report on the review of the draft Law on Inspection (amended).
Notably, the draft Law on Inspection (amended) has a separate section regulating the Inspectorate of the Ministry of Public Security, the Inspectorate of the Ministry of National Defense and the State Bank Inspectorate.
Article 13 of the draft Law clearly stipulates that the inspectors of these 3 agencies have the task of advising, developing and submitting to ministers and heads of ministerial-level agencies to promulgate and guide and urge the implementation of regulations on inspection organization and activities under the state management authority of ministries and ministerial-level agencies.
Develop a draft inspection plan, collect opinions from the Government Inspectorate, submit to ministers and heads of ministerial-level agencies for comments on policies, promulgate and organize the implementation of inspection plans.
Inspect the implementation of policies, laws, tasks and powers for agencies, organizations and individuals under the management of ministries and heads of ministerial-level agencies; inspect the compliance with policies and laws of agencies, organizations and individuals in areas under the state management of ministries and ministerial-level agencies.
Inspection when detecting signs of law violations; Inspection of other cases when assigned by ministers and heads of ministerial-level agencies; monitoring, urging, inspecting the implementation of their conclusions and recommendations and deciding to handle the inspection of ministers and heads of ministerial-level agencies.
Check the accuracy and legality of the decision to handle after inspection by the Chairman of the Provincial People's Committee for cases under the state management of ministries and ministerial-level agencies when necessary; synthesize and report the results of inspection work.
Assisting the Minister and Head of the ministerial -level agencies in performing the state management of citizens' reception of citizens, settling complaints, denunciations, anti -corruption and negative anti -corruption; Performing duties and powers in the reception of citizens, settling complaints, denunciations, prevention and anti -corruption, wasteful and negative in accordance with the law.
According to Article 14 of the draft Law, in the field of inspection, the Chief Inspector has the duties and powers to lead, direct, inspect and supervise inspection work within the state management scope of ministries and ministerial-level agencies; lead the implementation of inspection tasks and powers according to the provisions of this law and other relevant legal provisions.
Decide on inspection when detecting signs of law violations; sanction administrative violations or recommend competent authorities to sanction administrative violations according to the provisions of law on handling administrative violations.
Handling overlaps and overlaps between the activities of inspection agencies; report to the Government Inspectorate General for consideration and decision on handling overlaps and overlaps between the activities of inspection agencies.
Propose that ministers and heads of ministerial-level agencies suspend, according to their authority, the enforcement of illegal decisions in the field of state management of ministries and ministerial-level agencies discovered through inspections.
Recommend ministers and heads of ministerial-level agencies to resolve issues related to inspection work. Propose competent state agencies to amend, supplement, and promulgate regulations to comply with management requirements; propose suspension, cancellation, or removal of illegal regulations discovered through inspection.
Recommend ministries and heads of ministerial-level agencies; request heads of agencies and organizations to review responsibilities and handle organizations and individuals under their management who have committed violations of the law discovered through inspection or do not implement conclusions, recommendations, and handling decisions on inspection.
