On May 8, the National Assembly listened to the presentation and report on the review of the draft Law amending and supplementing a number of articles of the Law on Organization of People's Procuracy (KSND).
According to the submission, the titles of criminal investigation officers and appraisers are supplemented to synchronize with the Law on Organization of Criminal Investigation Agencies 2015 (amended and supplemented in 2021), the Law on Judicial Assessment 2012 (amended and supplemented in 2018, 2020); add the duties and powers of the People's Procuracy on administrative sanctions for acts that obstruct litigation activities.
The Legal and Judicial Committee realized that the Law on Organization of Criminal Investigation Agency stipulates the title of investigating officials; The Law amending and supplementing a number of articles of the Law on Judicial Assessment additional provisions of "Criminal Technical Assessment Department of the Supreme People's Procuracy conducts audio and images from electronic data" and "The Director of the Supreme People's Procuracy defines the functions, tasks and organizational structures of the Criminal Technical Inspection Department of the Supreme People's Procuracy, submitting to the National Assembly Standing Committee."
Therefore, the Law and Justice Committee approved the draft Law to ensure consistency with the Law on Organization of Investigation Agencies and the Law on Judicial Assessment.
Article 58 of the draft law stipulates that the judicial positions in the People's Procuracy include: Director, Deputy Director of the People's Procuracy, Military Procuracy at all levels; Prosecutors at all levels; Heads and Deputy Heads of Investigation Agencies;
Investigators of ranks; investigating officers; inspectors of ranks; criminal technical appraiser.
The transfer of prosecutors of ranks and investigators of ranks in the People's Procuracy and the Military Procuracy is regulated by the Chief Prosecutor of the Supreme People's Procuracy.
The number of procurators, the structure of the procurator's ratio at each People's Procuracy; The number and structure of the investigator ratio of the Supreme People's Procuracy is decided by the Standing Committee of the National Assembly at the request of the Director of the Supreme People's Procuracy after having the Government's opinion.
The number of procurators, the structure of the procurator's ratio at each military procuracies level; The number and structure of the investigating rates of the Central Military Procuracy decided by the Standing Committee of the National Assembly at the request of the Director of the Supreme People's Procuracy after agreeing with the Minister of Defense.
