From the beginning of September 2026, the Law amending and supplementing a number of articles of 9 laws on military and national defense officially takes effect.
9 related laws were amended including: National Defense Law; Law on Officers of the Vietnam People's Army; Law on Professional Military Personnel, National Defense Workers and Public Employees; Law on Military Service; Vietnam Border Guard Law; Law on People's Air Defense; Law on Reserve Forces; Law on Civil Defense; Law on Militia and Self-Defense Forces.
The promulgation of the Law amending 9 laws on military and national defense is an urgent requirement to promote decentralization and delegation of power; continue to arrange local military organizations to be "tight, streamlined, and strong".
The Law has amended and supplemented a number of articles of the Law on Officers of the Vietnam People's Army. The amended and supplemented regulations relate to the positions of officers of Commanders, Deputy Commanders, Political Commissars, Deputy Political Commissars of the Provincial Military Command; Commanders, Political Commissars, Deputy Commanders, Deputy Political Commissars of the Commune Military Command; the highest service age limit of Commanders of the Commune Military Command.
According to the new regulations of the Law, the Political Commissar of the Military Command at the commune level is an officer of the Vietnam People's Army. The Law also adjusts the group of positions of cadres under the Provincial Military Command and the Military Command at the commune level.
Through this, Commanders and Political Commissars of provincial-level military commands are transferred from the group of titles of Division Commander and Political Commissar to the same group as Commanders, Political Commissars of the Corps and Naval Region.
Deputy Commander, Deputy Political Commissar of the Provincial Military Command were transferred from the group of Deputy Division Commanders, Deputy Political Commissars of Divisions to the same group as the Deputy Commander, Deputy Political Commissar of the Corps and Naval Region.
The highest age of service for the Commander of the Military Command at the commune level is calculated according to the age limit of reserve officers at each military rank. Specifically, for the rank of captain, it is 53 years old, Major 55 years old, Lieutenant Colonel 57, Senior Lieutenant Colonel 59, Colonel 61 and General level 63 years old.
In addition, the law also amends and supplements Clause 3, Article 41 as follows: Based on the staffing needs, position standards of officers, military study results and achievements in national defense service, reserve officers appointed to positions in reserve mobilization units are promoted to military ranks commensurate with their assigned positions.
