The Ministry of Justice has just announced the appraisal dossier for the draft Law amending and supplementing 9 laws on military and national defense in: National Defense Law; Law on Officers of the Vietnam People's Army; Law on Professional Military Personnel, Workers and National Defense Public Employees; Law on Military Service; Vietnam Border Guard Law; Law on People's Air Defense; Law on Reserve Forces; Law on Civil Defense; Law on Militia and Self-Defense Forces.
Notably, the Ministry of National Defense proposed to amend and supplement Clauses 1, 2, 3 of Article 20 on Military Commands (CHQS) at commune level in the Law on Militia and Self-Defense Forces.
Accordingly, the Commune-level Military Command is a local military agency directly under the Hanoi Capital Command, Ho Chi Minh City Command, and Provincial-level Military Command.
The commune-level Military Command has the function of advising the Party Committee and superior commanders; the Party Committee and local authorities at the same level perform the function of state management of military and national defense in the locality; organize the construction, management, command, and operation of units and armed forces under their authority to be strong, ready to fight, fight and perform military and national defense tasks in the commune-level area.
Regarding the tasks of the Commune-level Military Command, the Ministry also proposed 10 tasks, including: Advising the Party Committee and superior commanders; Party Committees and commune-level authorities to lead the construction of the all-people national defense, the all-people national defense posture associated with the people's security posture, building defense areas, building comprehensively strong bases; advising the Commune-level People's Committee on the organization, construction, and mobilization of militia forces according to the provisions of law;
Advise the Party Committee and commune-level government to implement state management of local defense work; direct, manage, and operate the implementation of national defense and military tasks in localities; command and unify the armed forces when there are national defense situations according to the provisions of law;
Presiding over advising the Party Committee and government at the commune level to perform training and combat readiness tasks;
Coordinate with Police, Army and other forces in the area in drills, competitions, sports festivals, serving combat and fighting.
In addition, the Commune-level Military Command has legal status, seals, accounts, and private headquarters. Seal samples, seal engraving organizations, registration, management, and use of seals of the Commune-level Military Command are implemented according to the regulations of the Minister of National Defense.
