Staff streamlining policy for people working at the commune-level Military Command in Hanoi

Hanoi - Before September 1, 2026, the city will have a list of people who will enjoy the staff streamlining policy when reorganizing the commune-level Military Command.

Standing Vice Chairman of Hanoi People's Committee Duong Duc Tuan has just signed and issued an official dispatch on the implementation of the policy of streamlining staff for people working at the Military Command of communes and wards who quit their jobs due to the reorganization of the Military Command of commune level.

According to the content of the official dispatch, the subjects eligible to apply and resolve policies are those holding the positions of Commander of the Military Command, Deputy Commander of the Military Command, Assistant of the Military Command of communes and wards in the city before January 26, 2026, who have resigned due to the reorganization of the Military Command of communes and wards according to Resolution No. 66/12/2026/NQ-CP.

The document also clearly stipulates cases that are not subject to application or temporarily have not been resolved for policies, such as: People who have been arranged and assigned to positions and positions at the Military Command of communes directly under the Capital High Command (later reorganized); who have been transferred, rotated, and assigned to work by competent authorities according to suitable job positions at administrative agencies and non-business units.

Or have quit their jobs, resigned, transferred jobs, retired or terminated their duties before the time of reorganization, or resigned for reasons not due to the reorganization of the Commune-level Military Command; only participate in coordinating, supporting, and concurrently performing military and defense work in the locality and not being civil servants under the payroll assigned to work at the Commune-level Military Command, according to the management records of the competent authority; those who are pregnant, on maternity leave, raising children under 36 months old, except in cases where individuals voluntarily streamline payroll, are in the period of disciplinary consideration or criminal prosecution or are inspected or examined due to signs of violation.

Policy identification for each case is implemented according to Resolution No. 167/NQ-CP and Decree No. 154/2025/ND-CP, ensuring the right subjects, the right conditions, the right regime, not expanding subjects, not legitimizing dossiers without sufficient basis and not paying duplicate policies.

In case when applying the staff streamlining policy according to Resolution No. 167/NQ-CP, if the staff streamlining allowance for the job position being held is lower than the staff streamlining allowance for the job position before recruiting civil servants according to Law No. 98/2025/QH15, the selected subjects will enjoy the most beneficial policy according to regulations; do not pay multiple policies to the same subject, for the same reason of resignation.

To ensure the implementation progress, the City People's Committee stipulates a 7-step implementation process.

In which, the People's Committees of communes and wards are responsible for reviewing personnel records, decisions on recruitment, arrangement, appointment, assignment, assignment of tasks and records of reorganizing the Military Command of commune level to initially determine the list of people subject to policy consideration according to Resolution No. 167/NQ-CP.

After that, the People's Committees of communes and wards send the list and initial identification documents to the Capital High Command.

Along with that, the People's Committees of communes and wards complete dossiers for each case and send them to the Department of Home Affairs before August 4, 2026 for appraisal.

The Department of Home Affairs presides over the appraisal of the list of streamlined staff of agencies and units under the city's management according to point c, clause 1, Article 14 of Decree No. 154/2025/ND-CP.

The Department of Finance appraises the cost estimate for policy implementation for each eligible case as proposed by the Department of Home Affairs.

Based on the appraisal results of the Department of Home Affairs and the Department of Finance, the Department of Home Affairs summarizes and reports to the City People's Committee, submits to the Chairman of the City People's Committee for consideration and approval of the list of streamlined staff and implementation costs according to point a, clause 2, Article 14 of Decree No. 154/2025/ND-CP, ensuring completion before September 1, 2026.

After being approved by competent authorities for the list of subjects and implementation costs, the People's Committees of communes and wards are responsible for coordinating with the Department of Finance, the State Treasury of the region, the City Social Insurance and relevant agencies to carry out payment, settlement, and finalization of expenses; and resolve social insurance and health insurance regimes according to regulations.
