The National Assembly Standing Committee (NASC) has issued a Resolution detailing and guiding the implementation of the Law on Supervision Activities of the National Assembly and People's Councils on the supervision activities of the National Assembly.
The Resolution clearly states that the issue of explanation is selected according to one of the criteria. That is the issue assigned by the National Assembly and the NASC; issues showing signs of violating legal regulations or having many limitations and weaknesses that are slow to be overcome;
Or issues that are topical and pressing, emerging in the reality of social life; issues that are of concern to many National Assembly deputies (NA deputies), members of the Ethnic Council, Committees of the National Assembly, public opinion, voters and people; new issues that do not have implementation solutions, requiring to be clarified and resolved promptly to ensure the interests of the State, the legitimate rights and interests of organizations and individuals;
The issue has been raised in resolutions, conclusions, and supervisory recommendations of the National Assembly, the NASC, the Ethnic Council, and the National Assembly's Committee, but has not been implemented or has not been implemented effectively, failing to meet the set requirements.
The Resolution also stipulates that the person requested to explain is selected to be suitable for the issue of explanation.
Based on regulations, the Standing Committee of the Ethnic Council and the Standing Committee of the National Assembly decide on the organization of explanations, the content of explanations, the person requested to explain, the person participating in the explanation and the plan to organize the explanation session.
No later than 10 days before the date of organizing the explanation session, the Standing Committee of the Ethnic Council, the Standing Committee of the National Assembly shall issue a plan to organize the explanation session, sent to members of the Ethnic Council, the National Assembly Committee, the person requested to explain, the person participating in the explanation and relevant agencies, organizations, and individuals.
The plan must clearly state the purpose, requirements, issues of explanation, scope, people requested to explain, participants in explaining, time, location of the explanation session, level of publicity of the explanation session and other related contents.
In case they cannot directly attend the explanation session, the person requested to explain sends a document stating the reason and appoints their deputy to attend and answer on their behalf with the consent of the Standing Committee of the Ethnic Council and the Standing Committee of the National Assembly.
In case the question of explanation is related to the responsibilities of the Ethnic Council, other Committees of the National Assembly, the Standing Committee of the Ethnic Council, the Standing Committee of the National Assembly shall preside over the organization of the explanation session to collect opinions from the Standing Committee of the Ethnic Council, the Standing Committee of the relevant National Assembly and issue a plan to organize the explanation session.
If necessary, the Standing Committee of the Ethnic Council and the Standing Committee of the National Assembly can coordinate to organize an explanation session.
The Resolution also stipulates the criteria for selecting supervision topics.
The National Assembly's supervision topic is selected based on the criteria in the following order of priority.
Issues that are pressing, emerging at a macro level or have a major impact on people's lives, socio-economic development, national defense, security, and foreign affairs of the country are of concern to National Assembly deputies, voters and people, and are proposed or other issues decided by the National Assembly in accordance with the requirements of supervision and the reality of the country;
