On the morning of November 4, continuing the 10th Session, Government Inspector General Doan Hong Phong, authorized by the Prime Minister, presented a report on the draft Law amending and supplementing a number of articles of the Law on Anti-Corruption.
One of the new regulations is to increase the value of assets and income that must be declared and the level of asset and income fluctuations in the year that must be declared additionally.
The draft law stipulates that the agencies controlling assets and income include: Inspection Committees of the Party Committees at the grassroots level and above; Government Inspectorate; Supreme People's Court, Supreme People's Procuracy, State Audit, National Assembly Office, Office of the President, National Assembly Delegation Work Committee, Central agencies of socio-political organizations; Ministries, ministerial-level agencies, agencies under the Government; Provincial and municipal inspectorates.
The draft law stipulates increasing the value of assets to be declared from 50 million to 150 million VND; increasing the value of assets and income to be declared additionally when there is an increase in the year from 300 million to 1 billion VND.
This regulation is aimed at meeting the conditions of socio-economic development and prices have increased significantly compared to 2018.
According to the draft law, the agency controlling assets and income must monitor changes in assets and income of those subject to declaration through analysis and evaluation of information from the declaration or from other sources.
In case the discovery of assets and income in the year with fluctuations of 1 billion VND or more but the person with the obligation to declare does not declare, the asset and income control agency shall require that person to provide and supplement relevant information. In case the assets and income fluctuate, it is necessary to explain the origin of the assets and increased income.
If the person who is required to declare an unreasonable explanation of the origin of the property and income in the year increased by 1 billion VND or more, the property and income control agency will conduct verification.
The draft law also added a provision that "declaration and explanation of the origin of assets and additional income is one of the criteria for evaluating and classifying the level of task completion of cadres, party members, civil servants and public employees".
Reviewing the draft law, Chairman of the Law and Justice Committee Hoang Thanh Tung said that Point b, Clause 1, Article 35 of the amendment to regulations on property value and income must be declared as follows: " precious metals, gemstones, money, valuable papers and other assets in which each asset is worth VND 150,000,000 or more".
Clause 2, Article 36 amends the regulations on the level of changes in assets and income in the year that must be declared additionally as follows: "Supplementary declaration shall be made when the person subject to declaration has changes in assets and income in the year with a value of VND 1,000,000,000 or more".
Mr. Hoang Thanh Tung basically agreed with the provisions of the draft law on raising the value of assets and income that must be declared and raising the level of asset and income fluctuations in the year to be declared.
Regulations on reducing unnecessary administrative procedures for controlling declaration of assets and income of small value will improve the effectiveness of corruption prevention.
