The Government's electronic information portal on October 8 reported that the Inspectorate of My Tho City (Tien Giang Province) has just publicly announced the inspection conclusion on the issuance of certificates of land use rights, house ownership rights and other assets attached to land in My Tho City.
Previously, in April 2024, My Tho City Police reported to My Tho City People's Committee about a collective petition of 72 people related to the issue of a household named Le Quoc Vi being granted a Land Use Rights Certificate for a land plot of 2,051.8 square meters in Dao Thanh commune, My Tho city.
Also in April 2024, the People's Committee of My Tho City officially issued an official dispatch on the inspection of the issuance of land use right certificates, assigning the My Tho City Inspectorate to establish an inspection team.
After a period of inspection, the Inspection Conclusion completed in mid-July 2024 showed that this land originated from temple land, not personal land, so the above individual was ineligible to be granted a land certificate due to being an incorrect subject.
However, the fact that the People's Committee of Dao Thanh Commune confirmed the land origin incorrectly, the Branch Office of Land Registration of My Tho City did not verify it correctly with the cadastral records stored at the unit, and the Department of Natural Resources and Environment did not check and advise the People's Committee of My Tho City to issue the first land certificate to Mr. Le Quoc Vi (representative) who was not the right subject and did not meet the conditions for being granted a land certificate is a violation of Clause 2, Article 181 of the 2013 Land Law and Clause 5, Article 19 of Decree No. 43/2014/ND-CP dated May 15, 2014 of the Government.
The inspection conclusion clearly stated that, from the above legal bases, it was found that the above land plot located in Dao Thanh commune, My Tho city, originated as religious land under the management of Long Nguyen pagoda.
"The fact that the People's Committee of My Tho City issued a land certificate for the first time to Mr. Le Quoc Vi (representative) was not the right subject, not meeting the conditions to be granted a land certificate" - the inspection conclusion stated.
Notably, the Inspection Team also found that the file for the first issuance of a certificate of land use rights, house ownership rights and other assets attached to land of Mr. Le Quoc Vi (representative) showed signs of intentional wrongdoing and lack of responsibility causing serious consequences in performing official duties.
Therefore, the Chief Inspector of My Tho City transferred all case files with signs of crime to the Investigation Police Agency, My Tho City Police to handle in accordance with legal regulations.
The inspection agency said that the basis for transferring the case file to the police investigation agency is based on Point p, Clause 1, Article 80 of the 2022 Law on Inspection and Joint Circular No. 03/2018/TTLT-VKSNDTC-BCA-BQP-TTCP of the Supreme People's Procuracy, Ministry of Public Security, Ministry of National Defence and Government Inspectorate dated October 18, 2018 on exchanging information on crimes and resolving recommendations for prosecution discovered through inspection activities.
