On the morning of May 10, the National Assembly discussed in the hall a number of contents with different opinions of the draft Law amending and supplementing a number of articles of the Law on Advertising.
Delegate Tran Thi Thu Hang (Dak Nong Delegation) suggested continuing to review and consider a number of contents related to the rights and obligations of advertisers.
People affected by the transmission of advertising products are obliged to verify the reliability of advertisers; check documents related to advertising products, goods, and services. In case of not using or not understanding the goods, products, and services, the goods, products, and services must not be introduced.
According to the delegate, this regulation aims to enhance the responsibility of influential people in conveying advertising products because this is a group with a large number of followers and trust.
Their words and actions have a strong impact on consumers' purchasing decisions. Therefore, they need to be responsible for the information they convey.
However, to make these regulations strict, appropriate, scientific and practical, it is recommended to consider additional aspects such as the possibility that influential people can only read the original lines of the utilities stated on goods and products; influential people cannot use them.
It is necessary to strictly control the advertising of false information by celebrities as in the past, study strong enough sanctions and stipulate in the law's prohibitions to be more strict.
According to the delegate, in recent times, the authorities have continuously discovered cases of advertising fake goods, goods of unknown origin; inflating publications such as fake milk advertisements by host organizations; the advertising of Quang Linh Vlog, Hang Du Cac; the cigarette car accident...
Citing these cases, the delegate said that current legal regulations on advertising and related regulations need to continue to be improved and amended. The delegate suggested continuing to review and assess existing limitations and shortcomings, preventing false advertising, reviewing prohibited acts and responsibilities of relevant parties.
In particular, a more severe sanctions are needed when the revised Penal Code is being submitted to the National Assembly at the 9th Session and the process of implementing the Law amending and supplementing a number of articles of the Law on Advertising. Therefore, it is necessary to issue regulations on handling administrative violations that are strong enough to handle.

Delegate Chu Thi Hong Thai (Lang Son Delegation) proposed to add controlling advertising content on the network environment as a separate content to emphasize the urgency. Because the online environment is becoming the main advertising channel instead of traditional tools.
Since then, this environment has been easily exploited to spread untrue information, defraud, support poor quality products such as functional foods, medicine of unknown origin, gambling in disguise, etc.
Therefore, the delegate suggested that the drafting agency study and consider adding content to control, supervise and handle advertising content on networks, social networks, and cross-border platforms; supplement the responsibility of the Ministry of Culture, Sports and Tourism to carry out this task.
Regarding people affected by advertising, the delegate suggested adding a mechanism to support advertising information from state agencies. In case the transmitter cannot verify, it can send a document requesting verification to the state management agency and respond within a certain period of time.
Clearly stipulate that the transmitter must take responsibility if it violates the verification process and intentionally cooperates with untrustworthy partners. The delegate also proposed to clearly define the identification of influential people and celebrities such as the number of followers and interactions to avoid arbitrary application.
