The Ministry of Justice is appraising the draft dossier of the Decree adjusting the basic salary and bonus regime for cadres, civil servants, public employees and armed forces, which is being drafted by the Ministry of Home Affairs.
Regarding the bonus regime, the Ministry of Home Affairs believes that basically maintaining the policy in Decree No. 73/2024/ND-CP; completing the content related to monitoring, evaluating, and ranking the quality of cadres, civil servants, and public employees.
The drafting agency also proposed to amend and improve regulations on handling the balance of the year-end bonus fund to ensure the principle that the bonus fund of each year is associated with the reward for achievements of that year and avoid the occurrence of different interpretations in implementation.
Contributing opinions to the draft, the Ministry of Justice stated that the draft Decree stipulates: The annual bonus fund is outside the commendation fund according to the provisions of the Law on Emulation and Commendation, determined by 10% of the total salary fund (excluding allowances) according to positions, titles, ranks, grades and military ranks of subjects in the payroll of agencies and units...
The draft also stipulates that the subjects of the bonus regime are people doing jobs under the labor contract regime specified in Decree No. 111/2022/ND-CP, in cases where it is applied or there is an agreement in the labor contract applying salary ranking according to Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government.
However, Decree No. 111/2022/ND-CP dated December 30, 2022 of the Government stipulates: People working under labor contracts in administrative agencies and public non-business units who are not staffed, the number of people working and receiving salaries from the state budget is approved by competent authorities.
Thus, with the regulations on how to determine sources in the draft Decree, units are not allowed to allocate state budget funds to pay bonuses to employees performing executive work, serving the regulations in Decree No. 111/2022" - the Ministry of Justice stated.
Therefore, the Ministry of Justice proposes that the drafting agency consider supplementing the content of regulations/guidances on funding sources for implementing the bonus regime for subjects implementing labor contract regimes specified in Decree No. 111/2022.
Responding to the above opinion, the Ministry of Home Affairs received and agreed with relevant agencies to regulate and guide.
