The Ministry of Home Affairs has reported on the progress of preparation and some major contents of the draft revised Law on Occupational Safety and Health (OSH).
According to the drafting agency, after nearly 10 years of implementation, the Law on OSH has created an important legal corridor to ensure the right to work in OSH conditions.
However, in the face of new requirements of industrialization, digital transformation, international integration and rapid development of the labor market, amending and supplementing the Law on OSH is necessary to overcome inadequacies.
At the same time, the amendment also aims to improve the effectiveness of state management and meet practical requirements in the new period.
The report of the Ministry of Home Affairs also clearly states some major contents in this draft Law (amended). Typical amendments and supplements to regulations on occupational accident and disease insurance.
In order to ensure consistency and synchronization with the legal system on social insurance and improve the effectiveness of implementing policies on occupational accident and disease insurance, the draft Law focuses on a number of contents such as:
First, expand the subjects participating in compulsory occupational accident and disease insurance for people who are receiving pension benefits, but have signed contracts for 1 month or more.
Second, replace the "basic salary" with the regional minimum wage to contribute to raising the level of insurance benefits for people with occupational accidents and diseases (estimated at about 50% compared to the current level; and at the same time amend the related clauses at the salary level.
Third, amend the contents to ensure the consistency and synchronization of the contents with the Law on Social Insurance.
This amended law also proposes to amend and supplement regulations on occupational safety and health training activities, occupational safety technical inspection and labor environment monitoring.
