The Government issued Decree No. 319/2026/ND-CP regulating journey monitoring devices (TBGSHT), driver image recorders, and passenger compartment image recorders on road vehicles.
Regarding the requirement to install monitoring devices on road vehicles, the Decree stipulates that business transport cars, tractor-trailers, ambulances, road traffic rescue vehicles, and internal transport vehicles must install TBGSHT, driver image recorders, and passenger compartment image recorders as prescribed.
TBGSHT, driver image recorders, passenger compartment image recorders can be integrated into one or more devices to be installed on the vehicle but must fully meet the functions and technical requirements of each device according to the provisions of this Decree and the National Technical Regulation issued by the Minister of Public Security.
The Decree stipulates that monitoring devices on road vehicles must ensure the recording of the following data:
Data collected from TBGSHT includes: Vehicle journey, vehicle operating speed, information on the number and time of stopping and parking, continuous driving time;
Data collected from the driver's image recorder is recorded continuously in all lighting conditions about the driver's image;
Data collected from the passenger compartment image recorder is recorded continuously in all lighting conditions, including: Images in the passenger compartment, images of people getting on and off the vehicle;
Other data according to the regulations of the National Technical Regulation issued by the Minister of Public Security.
Surveillance devices on road vehicles have the function of automatically detecting and automatically warning of safety for acts of law violations, acts of causing unsafety to traffic order and safety of drivers and passengers in the passenger compartment, which are specified in the National Technical Regulation issued by the Minister of Public Security.
The Decree stipulates that the transmission of data collected from monitoring devices on road vehicles is carried out as follows:
Data collected from TBGSHT must be transmitted to service servers, from service servers to traffic police (CSGT) servers in real time;
Data collected from driver image recorders, passenger compartment image recorders transmitted to service servers and from service servers transmitted to the Traffic Police Department server in real time are data on violations of the law on road traffic order and safety of drivers, acts causing unsafety of road traffic order and safety of drivers, and violations of the law of people in the passenger compartment.
Data collected from TBGSHT is stored on this device for at least 30 days, on the service server for at least 1 year, on the Traffic Police Department server for at least 3 years;
Data collected from the driver image recorder is stored on this device for at least 3 days, data collected from the passenger compartment image recorder is stored on this device for at least 10 days;
This Decree takes effect from July 1, 2027.
