On November 21, the National Assembly discussed in the hall the draft Resolution on piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights.
Speaking at the meeting, delegate Pham Van Hoa (Dong Thap delegation) said that the real estate situation has been complicated recently.
In fact, there are cases where businesses have built but violated regulations without legalizing them, wasting social and national resources.
“Although not the state budget, enterprises are also social resources, they also have to borrow from banks, if enterprises die, banks will die too” – delegate Pham Van Hoa said and believed that this is an important and necessary issue to issue this draft Resolution.
Regarding the scope of regulation, the draft Resolution is applied nationwide to projects of real estate business organizations in the following cases: Receiving land use rights; Having land use rights; Having land use rights and receiving land use rights; implementing commercial housing projects on land areas of establishments that must be relocated due to environmental pollution, establishments that must be relocated according to construction planning and urban planning.
Delegate Pham Van Hoa agreed with the proposal that it should be applied nationwide. Because if we pilot it, it must be done publicly. "If we only apply it in some provinces and cities and some other provinces do not allow it, it will easily create a mechanism of asking and giving and wondering what is allowed in your province and what is not allowed in mine" - said delegate Pham Van Hoa.
According to this delegate, a core issue is whether the Resolution will be applied from the effective date or revert to previous cases. Major cities such as Hanoi, Ho Chi Minh City, Da Nang, and Khanh Hoa are facing this situation.
Accordingly, the apartment buildings have been built and people have moved in, but now they cannot complete the procedures because of legal problems. People and businesses need the National Assembly and the Government to help them solve this problem.
"We do not legalize violations for businesses, the core issue is to avoid waste" - the delegate of Dong Thap delegation said and added that currently, many high-rise apartment buildings have been built but the grass is growing over and seriously deteriorating.
