On September 21, at the Government Headquarters, Member of the Party Central Committee, Deputy Prime Minister Ho Quoc Dung chaired a meeting with ministries and relevant agencies on the draft Land Law (amended).
The Ministry of Agriculture and Environment said that the Ministry has developed a dossier on the draft Land Law (amended), organized to collect opinions from ministries, branches, localities, affected subjects, businesses and related organizations; and at the same time received and explained the opinions of agencies and localities and the counter-arguments of the Vietnam Fatherland Front.
The Ministry has completed the dossier and sent it to the Ministry of Public Security to get people's opinions on the VNeID system. Currently, technical units are completing procedures to submit the dossier to VNeID to serve people's opinions.
The draft Land Law (amended) is designed according to the new legislative thinking in Resolution No. 66-NQ/TW dated April 30, 2025 on innovating the work of building and implementing laws to meet the requirements of national development in the new era, in the direction that the law stipulates framework issues, principles; issues that frequently fluctuate are assigned to the Government, ministries, branches, and localities to regulate.
The draft law focuses on policy groups including: Innovating and improving the quality of planning and land use plans; perfecting regulations on land allocation, land lease, land use purpose conversion; perfecting regulations on compensation, support, resettlement and land recovery; perfecting financial mechanisms on land and land prices; perfecting the rights and obligations of land users, and land use regimes.
The draft also focuses on promoting administrative reform, digital transformation, improving state management capacity on land, decentralization, and delegation of power; innovating inspection, examination, supervision, handling of violations, resolving disputes, complaints, and denunciations about land, and at the same time tightening discipline, order, and preventing and combating corruption, wastefulness, and negativity.
Concluding the meeting, Deputy Prime Minister Ho Quoc Dung highly appreciated the delegates for focusing on discussing, clarifying and proposing solutions to remove obstacles in the draft Land Law (amended), especially issues of decentralization of land recovery authority, notarization regulations, compensation policies and land price determination.
The Deputy Prime Minister emphasized the requirement to study in the direction of only including in the Land Law (amended) regulations that are framework and principles, thereby limiting the need to regularly amend when new issues arise in practice.
Regarding the contents that still have many different opinions, the Deputy Prime Minister assigned the Ministry of Agriculture and Environment to take the lead in continuing to review and study carefully.
In which, it is necessary to re-evaluate the compensation policy, ensuring that loopholes are not created leading to loss of state assets and negative developments. Regarding the mechanism for calculating land prices and land price lists, it is necessary to study and design them in accordance with the actual conditions of each locality.
Research to include in the revised Land Law the principles on anti-speculation tax and handling of abandoned land; on that basis, assign the Government to specify details, ensuring that policies are implemented in accordance with reality.
