This content was requested by the Government in Resolution No. 278/NQ-CP dated September 18, 2026, the specialized meeting on law-making in September 2026 and some key tasks for socio-economic development in the coming time.
Regarding the draft Land Law (amended) submitted by the Ministry of Agriculture and Environment, the Government requests to study, supplement, and complete the contents on:
First, framework criteria, principles, mechanisms for determining, inspecting, and supervising land price decisions; policies on land prices, the role of the State in regulating, managing, and deciding land prices; land use fees, land rent for production and business land, housing development land, and lease.
Second, the financial mechanism to handle land rent differences, handle abandoned land, and slow land use; specifically stipulate criteria for determining these types of land.
Third, a mechanism to prevent acts of corruption, negativity, and profiteering from compensation, resettlement, and illegal construction policies.
Fourth, a special mechanism to definitively handle backlog and prolonged projects.
Fifth, accelerate the construction and connection of land data information according to the principle of maximum transparency to promote real estate transactions.
Sixth, simplify administrative procedures according to the principle of one focal point, one door; implement decentralization and delegation of power in the direction of the Government's general regulations, applied nationwide, localities are proactively simplified, no procedures arise, no complications in the implementation process; implement mandatory registration of land use rights and all land changes.
Seventh, implement notarization requirements for land use right transfer transactions to ensure compliance with specialized notarization laws, prevent and prevent risks of disputes and lawsuits.
Eighth, review and ensure synchronization and consistency with the draft Law on Housing (amended), the draft Law on Real Estate Business (amended) and other relevant laws.
Ninth, fully assess the policy impact and regulations of the draft Law, carefully review the regulations on transitional handling to ensure that there are no gaps and legal conflicts affecting the rights and interests of relevant organizations and individuals.
The Ministry of Public Security, the Ministry of Agriculture and Environment, and the Ministry of Construction urgently organize the collection of people's opinions through the VNeID system for 3 Laws: Land (amended), Housing (amended) and Real Estate Business (amended). The collection of opinions must be thorough, substantive, and effective.
The Ministry of Construction and the Ministry of Agriculture and Environment shall prepare a report on receiving and explaining the opinions of the people and publicly and transparently post this content.
The Government assigned Deputy Prime Minister Ho Quoc Dung to continue directing the completion of this draft Law. Assigned the Minister of Agriculture and Environment, authorized by the Prime Minister, to represent the Government in signing the Government's Submission to the National Assembly on this draft Law at the 2nd Session, 16th National Assembly.
