Mr. Nguyen Van Tuan (Hanoi) is currently the Deputy Military Commander of the ward. Previously, he was also the Vice President of the Ward Veterans Association. Every month, he receives a monthly allowance for holding the position of Vice President of the Veterans Association.
But from January 1, 2024 until now, he still holds the position of Vice President of the Veterans Association but does not receive the allowance for holding this position concurrently. Mr. Tuan wondered if this was correct or not?
Regarding the reflection and recommendation of Mr. Nguyen Van Tuan, the Ministry of Home Affairs has responded on the Electronic Information Portal.
Ministry of Home Affairs informed that according to the provisions of Article 34 of Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government regulating commune-level cadres, civil servants and non-professional workers at the commune level, in villages and residential groups, the Provincial People's Committee shall submit to the People's Council to jointly stipulate the titles of non-professional workers.
Accordingly, both positions that Mr. Nguyen Van Tuan is currently holding, which are defined by the Hanoi People's Council as non-professional positions at the commune level, are entitled to part-time allowances.
In addition, Article 20 of Decree 33/2023/ND-CP also stipulates the allowance for holding concurrent positions of commune-level officials as follows:
Commune-level cadres and civil servants who concurrently hold a position or title of commune-level cadres and civil servants different from the current position or title, and one person is reduced from the number of commune-level cadres and civil servants assigned by the district-level People's Committee according to the provisions of Clause 5, Article 6 of this Decree, from the date the competent authority decides on the concurrent holding, they will receive a concurrent allowance equal to 50% of the salary (level 1), plus the leadership position allowance (if any) of the concurrent position or title; the allowance for concurrent holding of a position or title is not used to calculate the contribution and enjoyment of social insurance and health insurance regimes.
In case of holding multiple positions and titles concurrently (including the case of the Party Committee Secretary concurrently being the Chairman of the People's Committee, the Party Committee Secretary concurrently being the Chairman of the People's Council), only the highest level of concurrent allowance is enjoyed. The District People's Committee decides on the positions and titles entitled to concurrent allowance in case the number of positions arranged to hold concurrently is greater than the number of commune-level cadres and civil servants reduced compared to regulations.
