On the morning of September 10th, in Hanoi, the Presidential Office held a press conference announcing the President's Order announcing the laws passed by the 16th National Assembly at the 1st Extraordinary Session.
At the meeting, Lieutenant General Le Van Huong - Deputy Chief of the General Staff of the Vietnam People's Army (VPA) introduced new points of the Law amending and supplementing a number of articles of 9 laws on military and national defense. This Law takes effect from September 1, 2026.
9 laws include the Law on National Defense; Law on Officers of the Vietnam People's Army; Law on Professional Military Personnel, National Defense Workers and Public Employees; Law on Military Service; Law on Vietnam Border Guard; Law on People's Air Defense; Law on Reserve Forces; Law on Civil Defense; Law on Militia and Self-Defense Forces.
According to Lieutenant General Le Van Huong, the study, development and promulgation of the Law is an urgent requirement to institutionalize the Party's guidelines and policies on national defense, continue to streamline the organizational structure of the provincial political system, operate effectively and efficiently; promote decentralization and delegation of power...
Lieutenant General Le Van Huong clearly stated that the law amending and supplementing a number of articles of the Law on Military Service on handling acts of evading military service; acts strictly prohibited of fraud in military health checks.
Along with that, amend and supplement regulations on reserve rank separation; organize the handover of citizens called up to the army; hand over non-commissioned officers and soldiers who have completed their service in the army; regimes and policies for citizens during the time of military service registration, preliminary selection, medical examination, and health check-up.
Accordingly, the law stipulates that evading military service is the act of not complying with the decision to call for military service registration; the decision to call for preliminary selection of military service health; the decision to call for military service health examination; the decision to call for military service enlistment; decisions and orders to concentrate training, drills, and check for mobilization readiness and combat readiness.
The new law also strictly prohibits fraud in military service registration; preliminary selection for military service; medical examination for military service.
In addition, the law also amends and supplements about non-commissioned officers and reserve soldiers who are past their age or are no longer healthy enough to serve in the reserve rank, they are disqualified according to the decision of the Commander of the Military Command of the commune level.
Regarding the policies and regimes of citizens during the time of military service registration, preliminary selection, medical examination and health check, the Law stipulates that citizens working at agencies and organizations during the time of military service registration, preliminary selection, medical examination, and health check are paid in full salary, current allowances, and travel expenses.
During the time citizens come to register for military service, preliminary selection, examination, and health check-up, they are guaranteed food, accommodation, and travel expenses.
