On March 25, according to the Ministry of National Defense's Electronic Information Portal, the Ministry of National Defense received a petition from voters of Lai Chau province to propose the Government to increase the regime and policies of the militia and self-defense forces as stipulated in Articles 7, 8, 11, 12, 13, 15, Decree No. 72/2020/ND-CP dated June 30, 2020 of the Government detailing a number of articles of the Law on Militia and Self-Defense Forces on organization and construction of forces and regimes and policies for militia and self-defense forces.
From 2020 to now, the Government has adjusted the basic salary up twice, however, the level of enjoyment of the regime and policies of the militia and self-defense forces has not been adjusted.
Previously, the Ministry of National Defense also received a proposal from voters of Binh Dinh province to increase the allowance and subsidy for the Commune Military Command and Militia and Self-Defense Forces, ensuring commensurate with the new basic salary level (according to Decree No. 72/2020/ND-CP dated June 30, 2020 of the Government detailing a number of articles of the Law on Militia and Self-Defense Forces; Resolution No. 69/2023/QH15 of the National Assembly on adjusting the basic salary level from July 1, 2024), ensuring commensurate with the work and responsibility of the Commune Military Command and Militia and Self-Defense Forces.
Responding to the content of this proposal, the Ministry of National Defense said that the Ministry of National Defense has presided over and coordinated with ministries, branches and 63 provinces and centrally run cities to study and draft a Decree amending and supplementing a number of articles of Decree No. 72/2020/ND-CP dated June 30, 2020 of the Government, including adjusting the increase in the level of enjoyment of a number of regimes and policies for militia and self-defense forces according to the current basic salary level.
On February 8, 2024, the Ministry of National Defense issued Report No. 523/BC-BQP explaining and accepting the direction of the Deputy Prime Minister on the draft amending and supplementing a number of articles of Decree No. 72/2020/ND-CP.
The scope of regulation is to increase the level of enjoyment of some regimes and policies of the militia and self-defense force, the level of enjoyment of allowances for militia and self-defense force command positions; the level of ensuring regimes and policies for each militia and self-defense force component; the agency responsible for ensuring funding, regimes and policies for militia and self-defense forces not participating in social insurance and health insurance.
However, Decree No. 73/2024/ND-CP dated June 30, 2024 of the Government stipulates that from July 1, 2024, the basic salary is VND 2,340,000/month; on November 27, 2024, the National Assembly voted to pass the Law amending and supplementing a number of articles of the Law on Health Insurance.
At point d, Clause 3, Article 12, it is stipulated that the standing militia are entitled to health insurance guaranteed by the State budget.
Therefore, the Ministry of National Defense continues to direct the Drafting Committee to adjust the draft to amend and supplement a number of articles of Decree No. 72/2020/ND-CP of the Government in the direction of increasing the level of enjoyment of a number of regimes and policies for militia and self-defense forces according to the new basic salary of VND 2,340,000/month and health insurance beneficiaries to comply with the current legal system, report and submit to the Government.
