After the 7th session of the 15th National Assembly, the Ministry of Home Affairs received comments from the National Assembly Delegation of Bac Giang province.
Accordingly, voters of Bac Giang province have requested the Ministry of Home Affairs to advise the Government to consider amending Clause 1, Article 20, Decree No. 112/2020/ND-CP dated September 18, 2020 of the Government on disciplinary action against cadres, civil servants and public employees to ensure consistency with the Law on Organization of Local Government 2015 in determining the authority to discipline the positions of Chairman and Vice Chairman of the People's Council at the commune level.
Regarding this proposal, the Ministry of Home Affairs has responded on the Ministry of Home Affairs Electronic Information Portal .
Accordingly, Clause 1, Article 20 of Decree No. 112/2020/ND-CP stipulates: The authority with the authority to approve and decide on the approval of election results has the authority to handle disciplinary actions, except for the cases specified in Clause 2 of this Article.
Clause 6, Article 83 of the Law on Organization of Local Government stipulates: The results of the election of the Chairman and Vice Chairman of the People's Council at the commune level must be approved by the Standing Committee of the People's Council at the district level.
According to the above regulations, the authority to handle disciplinary actions against the Chairman and Vice Chairman of the People's Council at the commune level belongs to the responsibility of the Standing Committee of the People's Council at the district level.
Pursuant to the provisions of the Law on Organization of Local Government and Decree No. 112/2020/ND-CP on the authority to handle disciplinary actions against Chairmen and Vice Chairmen of People's Councils at all levels, in the recent past, the Standing Committee of the National Assembly and the Standing Committee of People's Councils at all levels have issued Resolutions on handling disciplinary actions according to their authority, ensuring proper implementation of the Party's regulations on timely handling of disciplinary actions within 30 days from the date of announcement of the Party disciplinary decision.
