Changing the time to process regime records for militia and self-defense forces

The Government amends the procedure for examining and treating militia and self-defense forces who do not participate in health insurance if they are sick, have an accident, or are injured.

The Government has just issued Decree No. 220/2025/ND-CP amending and supplementing a number of articles of a number of Decrees in the fields of national defense and military when organizing local governments at two levels.

Decree 220/2025/ND-CP amends and supplements points b, c and d, Clause 3, Article 14 of Decree No. 72/2020/ND-CP related to "order for settling medical examination and treatment for militia and self-defense forces not participating in health insurance if they are sick, have an accident, or are injured" and points b, c and d, Clause 4, Article 15 related to "order for settling regimes and policies for militia and self-defense forces not participating in social insurance if they are injured or die".

The Decree is amended to reduce the time for processing documents and transfer the related responsibility of the People's Committee at the district level to the People's Committee at the commune level.

Amend and supplement Points b, c and d, Clause 3, Article 14 as follows:

Within 5 working days (the old regulation was 10 days), from the date of receipt of the application, the local military agency will prepare a set of documents.

The Commander of the Hanoi Capital Command, the Commander of the Ho Chi Minh City Command, the Commander of the Provincial Military Command, submit to the Chairman of the People's Committee at the same level for decision. The Commander of the Commune-level Military Command shall submit to the Chairman of the Commune-level People's Committee for decision.

Within 3 working days (the old regulation was 5 days), from the date of receipt of the dossier, the Chairman of the Commune People's Committee or the Chairman of the Provincial People's Committee decided on the cost of medical examination and treatment for the militia.

Within 5 working days (the old regulation was 10 days), from the date of issuance of the decision, the People's Committee at the commune level is responsible for paying for medical examination and treatment to the militia; the payment is by bank transfer or by post or received directly at the commune level.

Amend and supplement Points b, c and d, Clause 4, Article 15 as follows:

Within 5 working days (the old regulation was 10 days), from the date of receipt of the application, the local military agency will prepare a set of documents.

The Commander of the Hanoi Capital Command, the Commander of the Ho Chi Minh City Command, the Commander of the Provincial Military Command shall submit to the Chairman of the Provincial People's Committee for decision; The Commander of the Commune-level Military Command shall report to the Chairman of the Commune-level People's Committee for decision.

Within 3 working days (the old regulation was 5 days), from the date of receipt of the application, the Chairman of the Provincial People's Committee decided to provide subsidies to the militia.

Within 5 working days (the old regulation was 10 days), from the date of the subsidy decision, the People's Committee at the commune level is responsible for paying the subsidy to the militia; the payment is by bank transfer or by post or received directly at the commune level.

The Decree takes effect from August 7, 2025.
