Reporting to the Ministry of Public Security's Electronic Information Portal, Ms. Bui Thi Bich (character's name has been changed) said that she caused a fight with a neighbor and was given a suspended sentence of 5 months. She has completed her sentence and has not committed a new crime since the beginning of the sentence.
"The Ministry of Public Security, please tell me, when will my criminal record be deleted?" - Ms. Bich wondered.
Responding to Ms. Bich's opinion, the Ministry of Public Security said that, based on Clause 2, Article 70 of the 2015 Penal Code, amended and supplemented in 2017 and at Point a of this Clause, it is stipulated that: A person sentenced must of course have his criminal record cleared if since serving the main sentence or the probation period for suspended sentences has expired, that person has completed the additional sentence, other decisions of the judgment and has not committed a new crime within the following period:
1 year in case of being warned, fined, reformed without detention, imprisoned but serving a suspended sentence.
The Ministry of Public Security analyzed Ms. Bich's case, if after 1 year from the date of serving the probation period of the suspended sentence (the probation period of the suspended sentence is calculated from the date of the first instance announcement) and after serving the additional sentence and other decisions of the verdict and not committing a new crime during the above period, the criminal record will of course be erased.
