The Government issued Resolution 126/NQ-CP on the thematic meeting on law making in August 2024.
Regarding the draft Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army, the Government highly appreciated the Ministry of National Defense for presiding over and coordinating with relevant ministries and agencies to develop the draft law in accordance with the provisions of the Law on Promulgation of Legal Documents.
At the same time, it is necessary to promulgate the Law to institutionalize the Party's guidelines and policies and the State's policies on building the Vietnam People's Army, including building the officer corps; amend and supplement regulations to overcome difficulties and inadequacies, ensuring compliance with reality.
The Ministry of National Defense studies and fully absorbs the opinions of Government members in the direction of continuing to closely follow and clearly demonstrate the policies approved by the Government in the law-making proposal (Resolution No. 106/NQ-CP dated July 6, 2024).
Carefully review authority, ensure consistency and consistency with relevant legal regulations; strengthen decentralization, simplify implementation procedures, consult experts and scientists to complete the draft law.
Regarding the authority to specifically stipulate the position with the highest military rank of Lieutenant General, Major General and the highest military rank for the position and title of an officer is the general rank of a newly established unit or a reorganized unit: Report clearly and propose that the National Assembly decentralize this authority to the Government.
Regarding the maximum age limit for officers in active service: Unify regulations on equal retirement ages for male and female officers.
The Ministry of National Defense coordinates with the Ministry of Labor, War Invalids and Social Affairs to complete the content on retirement conditions, ensuring consistency with the provisions of the Labor Code and the Law on Social Insurance, while being suitable to the characteristics of military officers.
The Government also commented on the content that the Ministry of National Defense shall preside over and coordinate with ministries, branches, and provincial People's Committees to develop a plan for housing development for the people's armed forces under the management of the Ministry of National Defense, submit it to the Prime Minister for approval and organize implementation.
Another content is that local authorities at all levels, within the scope of their tasks and powers, are responsible for arranging land funds and handing them over to the Ministry of National Defense to develop social housing for the military.
Accordingly, unifying the orientation of social housing development for the army; especially forces in remote, border and island areas, in accordance with the characteristics of the army and the capacity of the locality; ensuring consistency and synchronization with the provisions of the Housing Law, Land Law, Planning Law, etc.
The Ministry of National Defense shall preside over and coordinate with the Ministry of Justice, the Government Office and relevant agencies to complete the draft law dossier in accordance with the provisions of the Law on Promulgation of Legal Documents.
The Minister of National Defense is authorized by the Prime Minister to represent the Government in signing and submitting the draft law to the National Assembly for consideration and approval at the 8th Session of the 15th National Assembly.
