The Government Office has just issued Notice No. 141/TB-VPCP concluding the Standing Committee of the Government on handling obstacles and inadequacies of Decree No. 46/2026/ND-CP and Resolution No. 66/13/2026/NQ-CP on food safety (ATTP).
According to the announcement, on March 16, at the Government Headquarters, Prime Minister Pham Minh Chinh chaired the Government Standing Committee meeting on handling obstacles and inadequacies of Decree No. 46/2026/ND-CP dated January 26, 2026 detailing the implementation of a number of articles and measures to organize and guide the implementation of the Food Safety Law and Resolution No. 66. 13/2026/NQ-CP dated January 27, 2026 on the announcement and registration of food products.
Attending the meeting were Deputy Prime Ministers, Minister of Health Dao Hong Lan, leaders of Ministries: Health, Agriculture and Environment, Industry and Trade, Science and Technology, Finance, Justice, Culture, Sports and Tourism, leaders of the Government Office, and representatives of the Ministry of Public Security.
After listening to the report of the Ministry of Health and the opinions of the delegates attending the meeting, the Standing Committee of the Government unanimously concluded on some important contents.
Accordingly, the Ministry of Health shall preside over and coordinate with the Ministries of Agriculture and Environment, Industry and Trade, Justice and relevant ministries and agencies to urgently study and absorb the opinions at the meeting, review, report, and submit to the Government before March 28, 2026 for consideration and promulgation of the Government's Resolution to:
Extending the period of temporary suspension of the effectiveness of Decree No. 46 and Resolution No. 66. 13 according to the provisions of Resolution No. 09/2026/NQ-CP dated February 4, 2026 of the Government on temporary suspension of the effectiveness of Decree No. 46 and Resolution No. 66. 13 until the Law on Food Safety (amended) and the Decree guiding the Law on Food Safety (amended) take effect.
Strengthen the implementation of direction and administration solutions to enhance the responsibility of management agencies, improve the capacity, effectiveness, and efficiency of food safety management; especially strengthening inspection, post-inspection, and supervision to ensure food safety.
The Ministry of Health shall preside over and coordinate with relevant ministries and agencies to urgently complete the draft Law on Food Safety (amended), ensuring quality and progress to submit to the National Assembly at the 2nd Session of the 16th National Assembly.
At the same time, build and complete the draft Decree detailing the Law on Food Safety (amended) and prepare well the conditions for implementation at the same time as building and submitting the draft law.
The Ministry of Health established a Working Group headed by the Minister of Health, with members including leaders of the Ministries of Agriculture and Environment, Industry and Trade, Public Security, Finance, Justice, Science and Technology and related agencies to perform the tasks mentioned in this notice.
Previously, Decree 46, Resolution 66. 13 guiding the implementation of the Food Safety Law were issued and took effect from January 26. The new regulations set out many stricter management requirements, especially for imported food, health protection food and state inspection activities on food safety.
The lack of guiding documents has caused the import of food and input materials for food production to fall into a state of congestion nationwide.
The main affected items are fresh agricultural products, preliminary processed products of plant origin such as vegetables, tubers, fruits, rice, rice, cassava, and some processed and pre-packaged foods.
After that, the Government agreed to postpone the implementation of both documents to April 15. During this time, regulations on food safety and hygiene for imported food and agricultural products are implemented according to old regulations (Decree 15).
