The Office of the President has just held a press conference to announce the President's Order promulgating the laws passed by the 15th National Assembly at the 8th Session.
In particular, the Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army includes 3 articles, taking effect from December 1, 2024.
Clause 4, Article 1 of the 2024 amended Law on Officers has amended and supplemented Article 17 of the Law on Officers on promotion of military ranks for officers in active service.
In which, the age requirement for promotion from Colonel to Major General and Rear Admiral of the Navy must be at least 3 years of service remaining. In case of not having 3 years of service remaining, upon request, the President will decide.
At the same time, add content to Clause 4 to assign the Government to prescribe criteria and standards for considering promotion to the rank of general officer beyond the rank of general.
Officers are considered for promotion before the time limit prescribed by this law in the following cases:
In battle, achieve outstanding achievements or receive awards at work.
Successfully fulfill duties and tasks for which the current military rank is two or more ranks lower than the highest military rank prescribed for the position or title the officer is holding, or the current military rank is lower than the highest military rank for the command or management position.
The Minister of National Defense specifies the criteria and standards for considering promotions of officers of the rank of colonel and lieutenant beyond their rank.
Notably, the amended law has increased the maximum service age of Colonel-level officers to 58 years old, so the provisions in Clause 3, Article 17 should be amended and supplemented as above to ensure strictness in considering and proposing promotions and to be consistent with the provisions in Clause 4, Article 22 of the Law on the People's Public Security (CAND).
Clause 4, Article 17 of the previous Law stipulates: "Officers on active duty with outstanding achievements will be considered for promotion to a higher rank" but does not assign authority to specify the above content in detail, leading to difficulties in implementation.
The above amendments and supplements are specific provisions of the Law on Officers as a basis for proposing the President to consider and decide on promoting generals beyond their ranks and the Minister of National Defense to decide on promoting colonels and lieutenants beyond their ranks.
This is within the authority prescribed in Clause 1, Article 25 and compatible with the provisions in Clause 4, Article 23 of the Law on Public Security; contributing to timely encouragement of officers of the Vietnam People's Army when they achieve exceptionally outstanding achievements.
Along with the above adjustments, Clause 5, Article 1 of the 2024 amended Law on Officers also amends and supplements Article 18 of the Law on Officers on consideration of early promotion and salary increase.
