At the 10th Session, the 15th National Assembly passed the Law amending and supplementing a number of articles of the Law on Citizen Reception, Law on Complaints, and Law on Denunciations. This Law takes effect from July 1, 2026.
This Law clearly stipulates the responsibilities of Chief Inspectors at all levels, Heads of units assigned to advise on resolving denunciations and the Government Inspector General.
Accordingly, Chief Inspectors in the People's Army, People's Police, State Bank of Vietnam, Chief Inspectors of Cipher, Chief Inspectors established under international treaties, Chief Inspectors of provinces and centrally-run cities, Heads of units assigned to advise on resolving denunciations are responsible as follows:
Verify the content of the denunciation, report the verification results, and propose measures to handle denunciations under the jurisdiction of the head of the state administrative agency at the same level when assigned;
Consider resolving denunciations that the head of the directly subordinate agency or organization of the state administrative agency at the same level (if any) has resolved but there are signs of legal violations; in case there is evidence that the resolution of denunciations violates the law, propose to the head of the state administrative agency at the same level to review and resolve them again.
The Law also stipulates that the Inspector General of the Government is responsible for receiving, classifying, and proposing the settlement of denunciations under the authority of the Prime Minister;
Verify the content of the denunciation, report the verification results, propose measures to handle denunciations under the authority of the Prime Minister when assigned; perform tasks authorized by the Prime Minister specified in point c, clause 8, Article 13 of this Law;
At the same time, consider resolving denunciations that the Minister, head of a ministerial-level agency, government-attached agency, or Chairman of the Provincial People's Committee has resolved but there are signs of legal violations; in case there is evidence that the resolution violates the law, propose to the Prime Minister to reconsider and resolve them.
The law also stipulates that the complainant has the right to withdraw the entire content of the complaint or part of the content of the complaint before the complaint settler issues a conclusion on the content of the complaint.
Denunciation withdrawal must be carried out by a denunciation withdrawal form or a record of the denunciation withdrawal opinion of the denunciator when working with the denunciation resolver or the denunciation content verifier.
According to the law, the person handling the denunciation is responsible for monitoring, urging or assigning the inspection agency at the same level or the unit advising on resolving the denunciation to monitor and urge the implementation of the conclusions of the denunciation content.
