Speaking at the hall, delegate Le Van The (Ninh Binh National Assembly Delegation) agreed with the necessity of amending the 2024 Land Law.
This person proposed that the handling of land acquisition should be linked to reorganizing the development space.
Delegate Le Van The emphasized that when the State invests in a road or a large infrastructure project, land acquisition should not only stop at taking enough area for the project.
If only the land within the project boundaries is recovered, after the project is completed, it may leave small, distorted, and difficult-to-reach land plots; production land is divided or ineffective for agricultural land cultivation" - delegate The stated.
Therefore, the proposal for site clearance is not only to get enough land for the project, but must also consider the efficiency of land use and the quality of space formed after the project.
Regarding Clause 6, Article 42 of the draft Law, it is stipulated that when land users have a need to recover the remaining area of the land plot, the competent authority decides to recover and implement compensation and support.
This regulation respects people's right to choose, but in the same project, a situation may arise where the remaining land plots have small, distorted or unusable land plots, while some people propose to recover, some people do not propose to recover.
If only handling according to the needs of each household, the spatial problem of the entire project may still be left open" - delegate Le Van The said and suggested that the Law should supplement objective criteria to assess the remaining land right in the process of preparing a plan for recovery, compensation, support and resettlement.
If the land can still be used, the people's right to choose must be respected. But if it is necessary to recover it to renovate and reorganize a larger space, there must be an independent legal basis, in accordance with planning, with a clear project, scope and plan; it is not possible to just rely on the needs of each household to solve an overall problem.
At the hall, delegate Ta Van Ha (Delegation of National Assembly Deputies of Da Nang City) mentioned the draft allowing land acquisition before approving the compensation, support, and resettlement plan. According to the delegate, this content needs to be carefully considered.
According to the delegate, the above regulations help accelerate progress and improve the efficiency of capital use, but must also be placed on the sidelines of stabilizing people's lives and livelihoods.
A family when land is recovered but does not have a resettlement place will face many difficulties. Where, how do children study, how are the elderly and sick..." - delegate Ha asked.
This person added that it is necessary to pay attention to the issue not only of how much money to compensate, but more importantly, to help people stabilize their lives. When land is recovered and relocated, this is the "sacrifice" of the people for the common cause of development.
Therefore, policies need to be built to be commensurate with that contribution, if they are recovered without considering resettlement, many problems will arise.
