On April 8, the Government Office announced that the Government has issued Resolution No. 74/NQ-CP promulgating a Plan to implement the arrangement of administrative units (ADUs) and build a 2-level local government organization model (plan).
One of the tasks and solutions set out in the plan is to complete policies, laws and guiding documents as a basis for the arrangement of administrative units and the organization of local government at 2 levels.
Based on the assigned functions, tasks and powers, central ministries and branches proactively propose and submit to competent authorities to issue or issue according to their authority legal documents and guiding documents to resolve issues related to the arrangement of administrative units, termination of district-level administrative units and organization of local government at both levels.
Ensure that after the arrangement of administrative units, the local government organizations at both levels operate smoothly, without interruption, and without legal gaps. Completion time is before June 30, 2025.
Ministries and ministerial-level agencies shall preside over and review the tasks, powers, authority, and administrative procedures of district-level authorities under the management of their ministries and branches and the contents that can be decentralized from the Government, Prime Minister, Ministers, and heads of ministerial-level agencies to local authorities at the provincial and commune levels.
On that basis, proactively issue according to authority or propose, report to the Government to issue documents for other provisions other than laws, resolutions of the National Assembly, resolutions, and Orders of the National Assembly Standing Committee. Completion time is before June 30, 2025.
In particular, the Government assigned the Ministry of Home Affairs to advise and submit to the Government to submit to the National Assembly for promulgation a new Law to replace the Law on Organization of Local Government in 2025; a new Law to replace the Law on Cadres and Civil Servants in 2008 (amended and supplemented in 2019). Completion date is before April 30, 2025.
The Ministry of Home Affairs shall advise and submit to the Government to submit to the National Assembly Standing Committee a draft Resolution on the arrangement of administrative units in 2025 before today (April 8, 2025).
Before November 1, 2025, the Ministry of Home Affairs shall preside over and coordinate with central ministries, branches and localities to issue a circular regulating the establishment and management of ADH boundary records.
The Ministry of Justice advises and submits to the Government for submission to the National Assembly to promulgate the Law amending and supplementing the Law on Promulgation of Legal Documents and Resolution amending and supplementing Resolution No. 190/2025/QH15 of February 19, 2025 of the National Assembly on handling a number of issues related to the organization of the state apparatus or new resolutions on handling a number of issues related to the organization of local authorities (if necessary). Completed time before May 15, 2025.
Before April 10, 2025, the Ministry of Justice shall preside over and coordinate with relevant ministries and branches to submit to the Prime Minister the assignment of ministries and ministerial-level agencies to develop and submit to the Government for promulgation of Decrees in specialized fields related to the organization of the apparatus, tasks and powers of local governments at the provincial and commune levels.
Before April 10, 2025, the Ministry of Justice issued guidelines for handling arising issues in the field of civil status, registering security measures when implementing the arrangement and reorganization of administrative units at all levels... and other related issues under the state management of the Ministry of Justice.
