The National Assembly Standing Committee has just commented on the draft Law on Teachers.
The draft Law on Teachers has a structure of 9 chapters and 71 articles regulating teachers; professional activities, rights and obligations of teachers; titles and standards of teachers; recruitment and use of teachers; salary and remuneration policies for teachers; training, fostering and international cooperation on teachers; honoring, rewarding and handling violations of teachers; and management of teachers.
The draft law applies to teachers in educational institutions of the national education system, state management agencies of education, education and training management agencies, educational institutions and related organizations and individuals.
Notably, the draft Law on Teachers has detailed regulations on cases of removal from management positions or dismissal of teachers holding management positions in educational institutions.
A teacher holding the position of educational institution manager shall cease to hold the management position if he/she voluntarily and proactively requests to resign from the management position for legitimate reasons and is approved by the competent appointing authority.
Other cases are not healthy enough, limited capacity or no longer prestigious enough to fulfill assigned duties and tasks; not meeting the standards of the head of an educational institution.
Teachers holding the position of educational institution management staff shall cease to hold the management position if they allow the educational institution or its member units, affiliated and affiliated units, departments, divisions, or professional or technical groups under the educational institution they are assigned to manage to commit serious violations; are disciplined from the level of warning or higher; are not reappointed or re-recognized; and have a retirement decision from a competent authority.
Teachers holding the position of educational institution management staff shall be dismissed if they fall into one of the following cases:
First, being disciplined with a warning; being disciplined with a reprimand but having reduced prestige and being unable to hold the assigned position.
Second, being disciplined with reprimand two or more times in the same term.
Third, there are two consecutive years of quality rating at the level of not completing the task.
Fourth, being concluded by a competent authority to have violated political standards according to the Party's internal political protection regulations to the extent that he/she must be dismissed;
Fifth, other reasons for dismissal according to Party regulations and laws.
Until there is a decision to cease holding a management position or to dismiss a management position from a competent authority, a teacher holding the position of educational institution manager continues to perform duties and exercise powers according to regulations.
Teachers holding the position of educational institution manager, after leaving the management position or being dismissed, will be assigned to a job position by the competent authority according to work requirements, suitable to the teacher's expertise and profession.
The authority that appoints teachers to hold the position of educational institution manager has the authority to dismiss or remove teachers from their management positions.
The Government details the contents related to the appointment, recognition, removal from office, and dismissal of teachers holding the position of educational institution managers.
