The Government has issued Decree No. 360/2026/ND-CP stipulating the conditions for investment and operation of preschool education institutions, general education institutions, continuing education institutions and other educational institutions under the national education system.
The Decree also clearly stipulates the cases of suspension of enrollment, suspension of educational activities for preschools:
1. Kindergartens are suspended from enrollment when they fall into one of the following cases:
In the process of operation, not ensuring one of the conditions for licensing educational activities as prescribed.
Organizing educational activities in the wrong licensed location.
Violating the provisions of law to the extent that enrollment must be suspended.
2. Kindergartens are suspended from educational activities when they fall into one of the following cases:
At the end of the period of suspension of enrollment according to regulations, if the cause leading to suspension is not remedied.
During the period of suspension of enrollment according to regulations, they still intentionally organized enrollment against regulations.
Violating the provisions of law to the extent that educational activities must be suspended.
The deadline for suspending enrollment and suspending educational activities for kindergartens is specifically defined in the suspension decision but not exceeding 12 months.
Thus, along with the initial conditions for establishment and licensing, the Decree sets out the requirement that preschool education institutions must maintain conditions on facilities, human resources and financial resources throughout the operation process.
These regulations take effect from September 17, 2026.
