Continuing the program of the 9th session, on the morning of May 14, the National Assembly discussed in the hall on the draft resolution of the National Assembly amending and supplementing a number of articles of the 2013 Constitution (the first time); The Law on the Local Government Law (amended).
Speaking, delegate Pham Trong Nghia - National Assembly Delegation of Lang Son province highly appreciated the work results of the Draft Committee for amending the Constitution in preparing the draft Resolution dossier.
Continuing to contribute ideas to draft the Resolution, delegate Pham Trong Nghia highly agreed with the provisions in Article 9 and the inheritance of the provisions on Vietnam Trade Union in Article 10 of the Constitution (amended), these provisions are of great significance in affirming the nature of our country's political system.
According to the delegate, Article 10 of the Constitution adds the phrase "representing workers at the national level in labor relations and international relations with trade unions".
The delegate said that this addition is necessary to affirm the irreplaceable role of the Vietnam Trade Union in representing the working class and laborers at the national and international levels.
However, delegate Nghia also said that the 2012 Trade Union Law, the 2024 Trade Union Law as well as the amended Trade Union Law at this Session all stipulate that Vietnam Trade Union is composed of many levels. In which, the central level is the Vietnam General Confederation of Labor.
"In reality, only the central-level trade union organization - the Vietnam General Confederation of Labor - has the authority to represent workers at the national and international levels in trade unions, such as participating in the National Wage Council, participating in activities of the International Labor Organization (ILO) and participating as a member of the World Trade Union Federation (WFTU)," said delegate Nghia.
Therefore, the delegate believes that if the general regulation as in the Draft is that the Vietnam Trade Union, it could lead to the understanding that all levels of trade unions, including the grassroots level, also have this authority.
"This is not suitable for reality and is not favorable, especially when there is the formation of other representative organizations of workers at the grassroots level, but these organizations have to make demands for rights like the grassroots trade union organization," delegate Nghia explained.
Therefore, the delegate asked the National Assembly to consider adding the phrase "central agency of the Vietnam Trade Union" in front of the phrase "being the representative of workers at the national level in labor relations and international relations on trade unions". At the same time, transfer this content to the end of Article 10 of the Constitution (amended).
The draft Resolution of the National Assembly amends and supplements a number of articles of the 2013 Constitution (first time) amending and supplementing Article 10 of the 2013 Constitution, as follows:
Article 10
Vietnam Trade Union is a socio-political organization of the working class and of workers, directly under the Vietnam Fatherland Front; representing, caring for and protecting the legitimate and legal rights and interests of union members and workers; representing workers at the national level in labor relations and international relations with trade unions;
Participating in state management, socio-economic management; participating in inspection, examination, and supervision of the activities of state agencies, organizations, units, and enterprises on issues related to the rights and obligations of workers; propagating and mobilizing workers to study, improve qualifications, professional skills, comply with the law, build and defend the Fatherland.
