The Lao Dong Newspaper Legal Consulting Office replied:
Clause 2, Article 2 of the Law on Forces Participating in Security and Order Protection at the Grassroots Level stipulates: Forces Participating in Security and Order Protection at the Grassroots Level are forces established by local authorities on the voluntary basis of the people to support the Commune, Ward and Town Police (hereinafter referred to as the Commune-level Police) to assist the People's Committees at the same level in protecting security and order and building a movement for the entire people to protect national security.
Clause 1, Article 31 of the 2025 Law on Employment stipulates the subjects participating in unemployment insurance as follows:
1. Employees participating in unemployment insurance include:
a) Employees working under indefinite-term labor contracts or labor contracts with a term of at least 01 month, including cases where employees and employers agree under other names but have content showing that the employment is paid, salary and the management, operation and supervision of one party;
b) Employees specified in Point a of this Clause who do not work full-time and have a monthly salary equal to or higher than the lowest salary used as the basis for compulsory social insurance contributions as prescribed by the Law on Social Insurance;
c) People working under a work contract;
d) Business management, controller, capital representative of the business as prescribed by law; Board member, General Director, Director, member of the Control Board or controller and other management positions elected by cooperatives and cooperative unions as prescribed by the Law on Cooperatives with salary.
In case the employee is simultaneously a member of many different unemployment insurance participants specified in this clause, the employee and the employer are responsible for participating in unemployment insurance along with participating in compulsory social insurance.
Thus, people participating in protecting security and order at the grassroots level do not have to participate in unemployment insurance.
