The Lao Dong Newspaper Legal Consulting Office replied:
Clause 1, Article 20 of Decree 250/2025/ND-CP detailing the establishment and operation of the property valuation council; the order and procedures for property valuation in criminal proceedings (effective from September 22, 2025) stipulates that the valuation of assets that are not prohibited goods must be based on at least one of the following grounds:
a) Price of assets with transfer or public offering activities on the market;
b) The price prescribed or decided by competent state agencies is the price prescribed or decided by competent state agencies or a decision that is effective at the time of being required for valuation. In case the competent state agency regulates the maximum price, minimum price, and price framework, the specific price level prescribed by the production and business agency or unit at the time of being required for valuation shall be applied;
c) Valuation report, Valuation certificate of valuation enterprises; price consulting report of price consulting units according to the provisions of law;
d) Price in legal documents and records on that type of property provided by competent authorities or the agency requesting the valuation;
d) In case one of the above grounds cannot be collected, the collection of other bases on assets to be valued is information and documents to help determine the value of assets to be valued, such as the assessment of the value of assets by competent state agencies or organizations and individuals with knowledge and understanding of assets; statements and documents of parties related to assets; assets prices similar to assets to be valued in other cases and have been previously assessed by the Property Valuation Council; prices of assets similar to assets to be valued collected on official electronic information pages of agencies and organizations in the region and the world when the Property Valuation Council expands the collection in the region and the world.
Thus, the valuation of assets that are not prohibited goods in criminal cases is based on the above grounds.
