Conditions and levels of benefits for security guards at the facility who have an accident

The Lao Dong Newspaper Legal Consulting Office replied:

Article 6, Decree 40/2024/ND-CP stipulates the conditions, benefits levels, order, procedures and responsibilities for ensuring funding to pay for regimes and policies for people participating in the force participating in protecting security and order at the grassroots level who have not participated in social insurance but have an accident or die while performing their duties as follows:

1. Conditions for enjoying the regime and policies as prescribed in Clause 3, Article 24 of the Law on Forces Participating in Security and Order Protection at the Grassroots Level in the following cases:

a) During the implementation of tasks according to the assignment or plan of competent authorities or when mobilized or assigned to perform tasks;

b) During the time and route from the place of residence to the place of performing the task.

2. The cases specified in Clause 2, Article 5 of this Decree for accidents and deaths are not entitled to the subsidy regime.

3. Benefit level:

a) In case of an accident: During the time of accident treatment, they are entitled to medical examination, treatment and daily food allowance, including in case of recurrent wounds until their health is stable and discharged from the hospital at the level decided by the Provincial People's Council;

b) In case of death-prone accident: Relatives are entitled to a death benefit and funeral allowance at the level decided by the Provincial People's Council.

Thus, people participating in protecting security and order at the grassroots level who have not participated in social insurance but have an accident will enjoy the above benefits and policies if they meet the prescribed conditions.
