Conditions for implementing the decision to enforce land dispute settlement

The Lao Dong Newspaper Legal Consulting Office replied:

Clause 5, Article 108, Decree 102/2024/ND-CP stipulates that the enforcement of land dispute resolution decisions shall be carried out when the following conditions are met:

a) The decision to resolve the land dispute has been in effect that the parties or one of the parties do not comply with the decision and have been by the commune -level People's Committee and the Vietnam Fatherland Front Committee of the commune where the land is located and persuasive without obeying;

b) The decision to enforce the decision on settlement of land disputes has been publicly listed at the headquarters of the commune -level People's Committee, the common living place of the residential area where the disputed land;

c) The decision to enforce the implementation of the decision to resolve land disputes has come into effect;

d) The person subject to enforcement has received the enforcement decision.

In case the person subject to enforcement refuses to receive the enforcement decision or is absent when the enforcement decision is handed over, the People's Committee at the commune level shall make a record.

Thus, the conditions for implementing the decision to enforce the settlement of land disputes are stipulated as above.
