On the afternoon of May 7, the National Assembly discussed in groups the draft Law on Organization of Local Government (amended); Law on Cadres and Civil Servants (amended).
Speaking at the discussion, Minister of Home Affairs Pham Thi Thanh Tra said that these two draft laws are part of a very urgent and urgent requirement in implementing the revolution of streamlining the apparatus and staffing. These two laws are a very basic and important basis for operating the entire civil service of the country and local governments at all levels.
Regarding the draft Law on Organization of Local Government, the Minister said that the focus is to establish a 2-level local government model, replacing the current 3-level model.
Of which, there will be about 99 tasks, the authority of the district level will transfer 90 tasks to the commune level and the remaining 9 tasks will be transferred to the provincial level.
When the National Assembly passes the Law on Organization of Local Government (amended), the Government will issue 25 decrees on decentralization, delegation of authority and division of authority. In particular, on May 9, it is necessary to complete the report to the Politburo on the implementation of decentralization and delegation of authority tasks.
Regarding the classification of administrative units (ADUs), the Minister of Home Affairs said that in the coming time, provincial-level ADUs will be classified into centrally-run cities, provincial-level ADUs of type 1, 2, 3 to correspond to each development and local governance condition.

Regarding the number of Provincial People's Council delegates, the Minister said that it will be adjusted according to natural area and population with a minimum of 55 and a maximum of 90. Here, we must achieve both goals of quality and streamlining.
Regarding the assignment of rights when the Chairman of the provincial People's Committee, the Minister said that in the administration of our country, the People's Committee and the Chairman of the provincial People's Committee have a very important position and role. If authorizing the locality so that the Standing Committee, the People's Council will assign the right to not ensure the management and management of the national administrative system from the central to local levels.
Therefore, this regulation remains the same, when there is a Chairman of the Provincial People's Committee, the People's Council will have a document to submit to the Prime Minister for decision. This issue was recently resolved by localities due to failure to act quickly, leading to a lack of timeliness in assigning the authority of the Chairman of the People's Committee.
With the draft Law on Cadres and Civil Servants (amended), the Minister said that this is an opportunity to comprehensively change the thinking and philosophy for the civil service and civil servants of our country.
In which, it is very clear to establish job positions because it is a tool, a continuous fiber, the center, the core for recruitment, use, management, fostering, rewarding, and discipline.
According to the Minister, this amendment still maintains the civil servant rank in the job position. This is considered a technical tool to determine the rank of public services in our country, if it is removed, it will be very difficult to determine.
"We still keep this line to implement and implement salary reform. If the civil servant ranks are removed, it will be very difficult to design issues related to mechanisms and policies," said the Minister.
The Minister also said that we must overcome the lifelong staffing thinking. Because if you just enter and sit firmly in your position, there will be no way out of your position. Therefore, we must design in such a way that there are opportunities to get in and out, completely eliminating the payroll for life.
To do so, it is necessary to implement 2 tools including assessment based on job position and use of contract mechanism (experts' contracts, scientists, job positions). This is a common trend in the world, which has been satisfactorily explained to the Government.
"There will be a separate decree on assessment, with KPI and data for assessment, taking work products as a measure, not a general determination," the Minister informed.
