Answering this question, Lawyer Do Thi Kim Hien (Ho Chi Minh City Bar Association) said that according to point d, clause 1, Article 112 of the 2019 Labor Code (LC), on the occasion of National Day, employees are entitled to a two-day full-time work holiday.
In addition, point c, clause 1, Article 98 of the Labor Code clearly stipulates that employees who work overtime on holidays are paid at least 300% of their salary, excluding holiday salary (100%). Therefore, the total income for employees who work overtime on holidays is 400% of their salary.
Applied to this year's National Day holiday, only when workers work overtime during the day on two holidays, September 1st and September 2nd, will they receive 400% of their salary.
Workers working at night (normal days) are paid at least 30% more than the normal daily salary.
Especially, if working overtime at night falls during holidays, the salary will be calculated according to the formula: 300% (overtime on holidays) + 30% (overtime at night) + 20% x 300% (daytime salary) = 390%.
If 100% of the salary of that holiday is added, the total income will reach at least 490% of the salary of a normal working day.
