Clause 2, Article 40 of Decree 109/2026/ND-CP Regulating penalties for administrative violations in the field of judicial support; judicial administration; marriage and family; civil judgment enforcement; recovery, bankruptcy of enterprises, cooperatives (effective from May 18, 2026), stipulates as follows:
2. A fine of 3 million VND to 5 million VND shall be imposed for one of the following acts:
a) Using other person's documents to carry out procedures for issuing a certificate of marital status;
b) Incorrect commitment of marital status to carry out procedures for issuing a certificate of marital status;
c) Providing false information and documents to be granted a certificate of marital status.
Clause 4, Article 40 of Decree 109/2026/ND-CP stipulates remedial measures:
a) Forced to return the originals of papers and documents that have been erased or modified to distort the content to the agency or person with authority that issued them for violations specified in Clause 1 of this Article, except in cases where the originals have been confiscated as prescribed in Clause 3 of this Article;
b) Proposing agencies, organizations, and competent persons to consider and handle issued papers and documents due to violations of the provisions of Clause 1 and Points a, b and c Clause 2 of this Article.
Thus, from May 18, 2026, people who provide false information and documents to be granted a certificate of marital status will be fined up to 5 million VND.
