Article 44 of the 2025 Construction Law (effective from July 1, 2026) stipulates the issuance of construction permits as follows:
1. Conditions for issuing construction permits for types of permits specified in Clause 1, Article 43 of this Law, including:
a) Suitable for the purpose of land use according to the provisions of land law;
b) Suitable for urban and rural planning or separate urban design according to the law on urban and rural planning or architectural management regulations according to the law on architecture or other sectoral detailed planning according to the provisions of the law on planning, except in cases of issuing a temporary construction permit;
c) Designing construction to ensure safety for works and neighboring works; fully implement regulations on environmental protection, fire prevention and fighting; ensure the ability to connect technical infrastructure.
2. A term construction permit is issued for works in areas planned according to the law on urban and rural planning or detailed planning of other sectors approved and announced by a competent state agency but not yet implemented and without a land recovery decision from a competent state agency.
3. The Government shall specify the conditions, authority, dossiers, order, procedures for issuance, adjustment, extension, re-issuance, revocation, cancellation and public disclosure of construction permits.
Clause 1, Article 43 of the 2025 Construction Law generally stipulates the issuance of construction permits as follows:
1. Construction permits include the following types:
a) New construction permit;
b) Permit to repair, renovate, and relocate works;
c) Construction permit with a valid term.
Thus, from July 1, 2026, the conditions for issuing construction permits are specified as above.
