Based on Clause 3, Article 48 of the 2025 Construction Law, regulations on conditions for starting construction of works are as follows:
Article 48. Conditions for commencement of construction of works
1. The commencement of construction of the project, except for cases specified in Clauses 2 and 3 of this Article, must ensure the following conditions:
a) Having construction site to hand over in whole or in part;
b) Having a construction permit as prescribed in Article 43 of this Law;
c) Having the construction drawing design of the project part, project item, and commencement project that has been approved;
d) The investor has entered into a construction contract with the contractor to carry out construction activities related to the project being started according to the construction progress;
e) The investor has sent a construction commencement notice in writing or online (except for individual houses of households and individuals) to the state management agency for construction in the locality.
3. The commencement of construction of individual houses of households and individuals only needs to meet the conditions specified in point b, clause 1 of this Article and is built on legal residential land according to the provisions of land law.
Accordingly, the commencement of construction of individual houses of households and individuals only needs to meet the conditions specified in point b, clause 1, Article 48 of the 2025 Construction Law and is built on legal residential land according to the provisions of land law.
Thus, the conditions for starting construction of individual houses from July 1, 2026 are specifically:
- Having a construction permit as prescribed in Article 43 of the 2025 Construction Law. (except for cases of being exempted from a construction permit at point g, clause 2, Article 43 of the 2025 Construction Law)
- To be built on legal residential land according to the provisions of land law.
