Accident regime records of security guards at the grassroots level

The Lao Dong Newspaper Legal Consulting Office replied:

Clause 4, Article 6, Decree 40/2024/ND-CP stipulates the dossier for enjoying the regime and policies for people participating in the security and order protection force at the grassroots level who have not participated in social insurance but have an accident or die while performing their duties as follows:

a) Dossier of application for accidents' allowance includes: Application for accident allowance (Form No. 02 of Appendix III enclosed with this Decree) enclosed with a hospital or deduction of a medical record after the treatment of an accident for inpatient treatment or a copy of a certificate of injury due to the medical facility where the emergency and treatment; Minutes of evaluation of working capacity decline of the provincial medical inspection council and equivalent or higher; In case of a traffic accident, there is an additional record of the police agency;

b) The application for death benefits and funeral expenses includes: Application for death benefits and funeral expenses (Form No. 02 Appendix III attached to this Decree) accompanied by a discharge letter or a copy of the medical records after accident treatment for inpatient treatment, a copy of the death certificate or an execution certificate; in case of a traffic accident leading to death, there must be an additional record from the police agency.

When state management agencies complete the connection and sharing of information data in the dossier components specified in this clause, the competent authority handling the procedure must exploit it online to resolve it without requiring the dossier submitter to provide paper documents.

Thus, the dossier for enjoying the regime and policies for people participating in protecting security and order at the grassroots level who have not participated in social insurance but have suffered an accident is prescribed as above.
